not trying to argue with you, just have seen what the state considers incompetent and how that can be handled. I’d be very very surprised if there wasn’t a lengthy hospital stay to prepare him for his trial. He isn’t stable, or tbh smart, enough to assist in his defense. You can not, and they will not, prosecute in that state (today, early mid 1900s and before is a whole different story). Whether or not once he’s had counseling and meds he can participate is a different story, though they’re usually so crushed by that point they plead out.
If I was a betting person I’d bet this isn’t going to be an easy ride.
