BART police handcuff, cite man for eating sandwich on platform

PLEASANT HILL, Calif. (KGO) -- A Concord man is speaking out after he was handcuffed and detained by BART police for eating on the platform at the Pleasant Hill station.

Steve Foster of Concord tells ABC7 News this all happened Monday morning at the Pleasant Hill station when he was approached by a BART police officer.

"I was just up there eating my sandwich waiting for the train to come."

Foster says the officer, wearing the name badge McCormick, walked past several other people eating and drinking on the platform and confronted him. His girlfriend caught the interaction on her cellphone.

He was even handcuffed.

"I'm definitely upset, mad, a little frustrated, angry about it," said Foster.

BART says state law prohibits people from eating or drinking in the paid portions of the station. In other words, from the time you enter the turnstiles to the time to exit them at your destination.

BART released a statement on Friday in response.

"He was not arrested. He was cited for eating, which is a violation of state law," said spokeswoman Alicia Trost.

She adds the man was lawfully handcuffed after refusing to provide his name multiple times. Once he provided his name, he was cited and released."

Foster doesn't plan to sue, but he does have some advice.

"I hope they start focusing on stuff that actually matters like people shooting up dope, hopping the BART, people getting stabbed."

I don't care for onions myself. I was just curious why someone would just keep eating it like that rather than escalating the situation. I mean I get that the law is stupid, but I'm too lazy to start a sandwich rebellion and from the looks of that guy he is too.

This reminds me of the time a brown skinned lady took a pic of a black worker on the transit eating and posted it online because it’s against the rules to eat there and people accused the brown skinned lady of being racist and she lost her book deal because of it.

why have rules if you are unwilling to enforce them? I’m surprised he didn’t grab the sandwich out of the black mans hand and throw it on the ground after he kept taking bites of it after being told he can’t eat there. It’s disrespect to keep taking bites after being told it’s against the rules. But I guess the ticket is more serious than having ur sandwich thrown on the ground.

We're talking about the bay area. Laws are so randomly enforced, he could've done this every day for years without getting in trouble, so probably figured it was NBD.
 
It's not actually a violation of state law. It's a violation of BART ordinances that are then reinforced by state law, so uhhh... well done with the PR campaign, BART.

California Public Utilities Code 99580 states:
(a) Pursuant to subdivision (e) of Section 640 of the Penal Code*, a public transportation agency may enact and enforce an ordinance to impose and enforce an administrative penalty for any of the acts described in subdivision (b).
. . .​
(4) Smoking a tobacco product, eating, or drinking in or on a system facility or vehicle in those areas where those activities are prohibited by that system.
* CA Penal Code 640 (b) (1) Eating or drinking in or on a system facility or vehicle in areas where those activities are prohibited by that system.

Black people and sandwiches haven't had the best track record as of late; I can't fault the cops for doing their jobs here. Nobody deserves to be caught in the crossfire when Jamal gets shot up for buying the last popeyes chicken sandwich.
 
Isn't this the system that stopped reporting "youths" robbing people to the police?
Those are also the fucknuggets that won't release camera footage of subway incidents because it would support racial stereotypes.
