AfD members not allowed to own guns, German court rules - People who support the "wrong" party, can't own guns in Germany.


Those with connections to Germany’s Alternative für Deutschland (AfD) party are not allowed to own firearms, according to a decision by a Düsseldorf Administrative Court.

In its ruling on July 1, the court determined that members of political parties suspected of harbouring anti-constitutional sentiments should be classified as “unreliable” under firearms legislation.

As a result, the court dismissed lawsuits filed by two AfD party members, a married couple, who had their weapons possession permits revoked.

Under the ruling, they have to surrender or destroy their firearms and ammunition although they can still appeal the court’s decision.

The man has 197 weapons in his possession and the woman 27.

“Membership of a party that is suspected of anti-constitutional tendencies alone regularly leads to the presumption of unreliability under weapons law according to the applicable strict standards of weapons law,” the court said.

“Even if the party has not been banned by the Federal Constitutional Court on the grounds of unconstitutionality.

“For the assessment of whether such anti-constitutional tendencies exist, the assessment of the offices for the protection of the Constitution is a weighty indication.

“The federal party AfD was classified as a suspected case by the Federal Office for the Protection of the Constitution, which was confirmed by the Higher Administrative Court for the State of North Rhine-Westphalia … The chamber has agreed with this.”

Such strict interpretation of gun laws did not violate party privilege as enshrined in Article 21 of the Constitution, according to the Administrative Court.

Its ruling emphasised that background checks for firearm licences were conducted on an individual basis and Article 21 did not shield political parties.

The court went on to state that party rights were not violated even “if civil servants or soldiers are subjected to disadvantages, up to and including dismissal from service, if they support a party that is not prohibited but is hostile to the Constitution”.

Weimar Germany took similar measures in an attempt to stop the Nazis. But I'm sure that turning the far-right into public court martyrs will totally crush their support this time. 🙄

This is the goal if Germans can get away with it here then lefties will say why don't we just ban Trump supporters from owning guns and politicize the ownership.

Ahh yes, arbitrarily infringe on the rights of your political opponents because they don't agree with you. What could possibly go wrong! (Yes, firearms ownership and defense is a right. The Second Amendment in the US does not grant this right, but merely enumerates it. Just like all the others in the Bill of Rights.)

Jeezus, it's not merely "removing the rights of those you disagree with", but they flat out admit there's zero due process. "Membership of a party that is suspected..." i.e. not proven. This is literally political persecution. They admit that they're doing this even though AfD has not been proven to have "anti-constitutional tendencies", let alone banned. It's a perfectly legal political party, but the kikes don't like it, so they're going to make everyone's lives miserable.

It's not like you can use your gun for its intended purpose in this shithole country anyway. If you're not at a government approved range or travelling to or from it the gun has to be unloaded and placed in a government approved safe. You also consent to having your house randomly checked by the cops so they can make sure you actually have it in your safe and the safe is locked. The only exemptions are for hunters and cops (and feds by extension).

Nobody's rights were infringed since you don't have a right to a gun in Germany anyway. You have a right to beg the gubmint to own one, and the government can say nein to it because they don't like your mustache. Such is life in a country without a second amendment.
 
No doubt makes it easier to arrest anyone they want to hassle for suspicion of violating gun laws. If there's no right to bear arms, I don't know what to tell you...the government sets the rules.
