They all need to be arrested, but I can understand why the Trump Administration is gun shy. We like to throw the term around, but a situation like this has quite literally not happened since the civil war. We are talking about arresting the senior leadership of an entire State of the Union. The last time the Union did this was against the State of Maryland, and that was after the guns had already started firing. The case really has to be ironclad, and more importantly, it has to justify sending in the Army.

The Feds can get away with arresting a rando Governor for fraud or tax evasion, but we are talking Sedition here, and that is at its fundamental nature a political crime. Constitutionally, political crimes have a much higher bar to reach. The Feds can't just say that a States elected officials politically disagree with them. They have to prove that their actions have escalated to the level of insurrection. That is an insanely high bar. More importantly, if that bar has been reached, then the Army has to be sent in to put the State under federal control by force of arms.

Its actually an unwritten requirement. If Trump manages to arrest Walz, Flanagan and Ellison, the mere act of arresting actually goes against his argument that the State is in rebellion. If the state is in rebellion, why can federal officers just march into the offices of the senior leaders of a State and slap hand cuffs on them? The Military intervention is actually a requirement here. The situation has to escalate to the point that the Army is required before we actually see these people taken down.
