Why technically true, again Hanlon's Razor: don't mistake malice for stupidity.I've heard from a couple sources that this isn't always the case, that if mistrial occurs as a result of some intentional act by the prosecution then double-jeopardy applies and the case cannot be retried. BIG IF TRUE
Although in this case you MIGHT be able to state that the prosecution literally did something the judge just told them not to do only minutes before.
