As to the "make Melinda run it by a lawyer before going forward " thing, during one of the times my personal lolcow sued me he was given a pro bono lawyer as part of the informera pauperis filling. This meant that he had to run his initial complaint through a real lawyer before it would be allowed to be served upon the defendants. He traveled to the lawyer with much fanfare, "evidence" in hand and A HUGE smile on his face and much gloating on his web postingS as to how he was gonna get us all.
A week later his pro bono lawyer filed a dismissal.
Turns out real lawyers can't be a party to frivolous complaints. Who woulda thunk!

The saddest part of this is that Null has had the patience of Job with Melinda. This all started with him trying to protect her from a stalker and for his troubles he has had to deal with her shit for years. She has had ample opportunity to avoid the consequences of her abuse of the legal system. Null could have hammered her the last 5 fucking times she sued him. The only reason he is doing it now is because she committed perjury by claiming she did proper service and managed to secure a default from the Clerk of the Court.
You CANNOT ignore that. She is the Dog who caught the car. You can pity the beast for its stupidity. You can feel bad for its puppies and anyone with an emotional attachment to it. But that dog in the end chose to chase the cars, and every time it avoided being turned into road paste did not deter it one moment. And if it was not pasted today, it would just keep chasing cars, and perhaps cause an even worse outcome. Maybe a driver with more compassion then sense would swerve off the road and crash into a tree. The dog would be fine and the innocent driver would be dead.
There should be no moral argument for Melinda here. This is the future she chose.

Edit : all pleadings essentially "ask for this" but state it differently. Only the court says "it is so" now a days.
