I have a feeling lemons told him to hire their transcriber and he will for sure get something transcribed that can bring Nick in, which never happened cause that's a lost cause and a waste of time.This made me lol harder than it probably should've. Another thing that's mildly exasperating is how they use three different formats for Tables of Authorities. The proper form is italics for case names. However, they use italics for case names, underlines for case names and plain text for case names in different documents. Why? Couldn't they at least have done a one pass over the final documents to ensure they looked the same and used the proper style?
At least this isn't the Central District of California where you'd actually get reamed out for this kind of shit.
Also, more importantly, the document styled VICTOR MIGNOGNA’S SUR-REPLY TO APPELLEE FUNIMATIONS, LLC’S RESPONSE BRIEF is missing two required sections, the Certificate of Compliance with Tex. R. App. 9.4, which is supposed to include a word count, and a Certificate of Service.

Interesting angle. We've been mostly focused on the breached contract with KamehaCon, but here in the reply they're also attacking the breached contract with Funimation (as a voice actor)

If serious enough, I'm assuming the appeals court could just strike it for noncompliance (which would be really fucking infuriating). Question is, that wouldn't make the case against Funimation dead, right? They could still work with what they already have filed?

17-0 refer to the causes dismissed by TCPA, not the number of affidavit.

17 - 0 is Ron bragging about the number of Vic's claims that were dismissed.
The the 16 you mentioned in the screenshot is the amount of affidavits supporting Monica, Ron, Jamie and Funimation. They're totally different things.

Okay, was just getting confused and the long months got me to forget it's in reference to the TCPA since it and mentions of the affidavits kept being called out at once at Ron to mock him.
Lemoine getting called out is funnier, though.
So did Lemoine truly lie to the judge about the fees? Ron might've drunkenly dropped a hint he did last night, but I guess Vic's lawyers were suspicious about it.

I'm going through Marchi's right now, and it seems a lot less crisp than Rial/Toye. Wish I had the clerk's record because without them the defamation arguments seem kind of limp. There's a reference to "Vic is a bad man," which is easily a statement of opinion.
Scratch that, never mind. They're getting to what I presume is the hair-yank assault on page 21.
Most of filing seems to be hammering at "Fact question, fact question, fact question."
Tortious interference arguments still seem kind of limp, but they were always limp. I wonder why they didn't do what they did with Monica and Ron, and brought up Vic's contract with Funimation. As an ADR director and writer, she would know if Vic had active roles at the time. Pretty sure he was currently acting in Morose Monokean.
