The appeals court "may" dismiss an appeal if they don't do what the letter requires. My guess is they'd accept a motion within that time for an extension. Presumably BHBC could oppose it, although that would be pretty cheeky.

I would call it justice if he wins the case, and is allowed to continue with his life.
Even if he is not awarded any money in regards to this lawsuit.

How optimistic am I?
Cautiously. there are plenty of other cases that have been demonstrating that rape accusations should be held accountable, and utilizing MeToo as ways to ruin lives has been shown to not be tolerated in courts.
Smollet is back in courts for his antics, and even CNN got brought to term for targeting a smirking kid.

If this whole thing took place in a law school exam in my home shit home: Depends. Vic might have a case against the landwhale (bit of a stretch) and Funimation, but he'd have MoRon dead to rights beyond any reasonable doubt.

Realistically speaking: I'd paraphrase the Dayton Peace Agreement and say 51/49. There are unpredictable human elements such as lawyers being not as smart as they thing they are and the fact that we live in a society. Even if the appeals succeed, we don't know which points will be brought back on the table. And even then, who knows if Vic will win. Then again, I've personally witnessed crazier things than a man winning a #MeToo case against a bunch of shrieking harpies. It can go either way, but I'm leaning more towards the pessimistic side.

They have to know that the chances of getting any more money from the Court of Appeals is unlikely, and they have to know that will be more work they aren't getting paid for. Not being paid, in itself, is a reason to drop a client... so could they possibly (Though I am unwilling to posit, probably) have told MoRon to take a long walk of a short pier?

We just need to remember back to a couple weeks ago when Ty was pathetic for "begging" for an extension and filing a motion to extend time BEFORE the appeals court had to kick out a "where's the brief" letter threatening to dismiss the appeal.
