Wish we could get the transcript, because I was sure it was mentioned that Chupp was very clear and specific that he wanted to make sure the court recognized vic had the right to appeal when lemonboy was pulling some stunts..
Well there was the early Nov hearing where that happened. Basically Lemonaids trying to say the filed appeal was early and worst case scenario Vic could still appeal....just the fees though.

Edit: Also didn't the fees hearing go on for about 4+ hours so could take a little longer than normal to transcribe.
 
There's 2 things that I'd like clarification on from this motion.
1: is it normal for the DENIED part to be bolded? I know it's allcaps because its a legal term and thet always do that but I don't think I've seen it bolded before.
2: and this may be a massive hot take. Either way I'm sure I'm being overly cautious. But the lack of legal resoning does worry me a bit. I mean, I'm sure it's probably a case of "it's so obvious it doesn't need to be mentioned", but I wish they'd at least say "because final judgement already happened anyway." You know, just to reassure us that the COA isn't about to start issuing bench rulings with no reasoning ala Chupp. I swear if the appeals is just 3 chupps put together like an exceptional legal voltron I might not be able to take it without drinking enough alcohol to get Nick to be concerned about it.
I know that's extremely unlikely, but this is fucking weeb wars. If it can go sped, it will go sped.

2. They don't need to give reasoning. Its denied because the issue is moot. There's no legal analysis to make, it if wasn't timely when filed, it would automatically ready when it became timely

If nothing else beforehand it should've been a huge red flag to MoRonica that neither Johnson nor Volny bothered to file their own Motions to Dismiss at the CoA.

I'm still considerng what would be the best outcome at the end of this shitshow:
1.) Lemon Fuhrer exhausts the costs with full consent from MoRonica and drives these nuts willfully into bancrupcy.
2.) MoRonica are completely clueless idiots and eventually file a malpractice suit against the lungless wonder. Still bancrupting them.

For what its worth I dont think they are paying their own fees to begin with. I think Sabot and the rest of their "click" are all chipping in to sand bag this whole thing to protect funi and oakatron.

Ron also may think that they will be victorious in the end so all this doesn't matter.

Ron and Monica may very well be the only ones that let this get to court. Funimation would settle unless Fukunaga is all obsessive about keeping Vic out of the industry.

I’m shocked that Funi didn’t settle at all. They had ample opportunities to do this in the past and they chose not to. Hell, Chupp even had them do that belated mediation and they still chose not to settle. I don’t get why Funi just couldn’t settle if they wanted to make this go away.

This tells me one of two things: either they’re that grossly incompetent or they’re that hellbent on destroying Vic, and given how many of these VA’s behaved since January, I would say it’s more of the latter than the former.

Ironically, the motion actually had merit at the time it was filed. It was just an absolutely stupid waste of effort. Why file such a motion? What did it accomplish? Literally fucking nothing.
