I've tried to rationalize their legal strategy and the only thing I could come up was this... They wanted to win the court of the public, not the court of law. Try to imagine how things would have played out if Ty didn't confront Casey about the deposition TCPA plan. Vic would get deposed, likely concerning gossip issues like sexual partners and instances of cheating, and that would be the message the case would leave for a 2-3 month period. All the youtubers covering the case like hero hei and yellowflash would move on to other controversies and likely only nick would have come back to the case once the TCPA was beaten. The public at large would have largely forgotten about the case and Vic would only have the reputation his opponents gave him.

That's whats at stake here for Casey. He knows the case is a lost cause, but if it comes out that his clients are liars while the majority of the public is watching, his clients will lose everything and be unable to find work in the industry or cons. So he's stalling. These shenanigans with confidentiality with this perspective in mind make more sense. "Welp, I can't prevent Vic and Ty from getting evidence before slowing the case down with the TCPA. My best bet now is to get him into a confidentiality agreement so that he can't talk about that evidence." He wants his side to appear in the right before shutting down discovery and losing interest for the majority of folks watching. Because at that point, it won't matter if he wins or lose. His clients will be able to find some work.

Unfortunately for them, Broly movie was a fuckin smash. Fans demand for Vic rose even higher than ever before, and now all they can do is bash a late night internet talk show host because he figured out their plot and made them somehow “fear for their safety and sanctity of their case”

and their opposing counsel was way smarter than a “super lawyer” that they had to resort to trying to hide the fact they have ZERO evidence by trying to have the public question said counsel instead of admitting they’re filthy liars and just wanted to get rid of a man they didn’t like.

Oh and for those that missed it, his major complaint about not being given the full text stearm... it's his clients text conversation. Casey is in full scumfuck lawyer mode. Hopefully he holds Judge Chupp in as much contempt as he does BHBH. I mean, he is just some pissant Tarrant County judge and Casey is a Dallas Superlawyer, right? I'm not going to need to pick up hot sauce when I go grocery shopping this weekend.

She did not voice any discomfort, but simply took the opportunity to exit when somebody knocked on the door. assuming everything said in the defendants response is true, taking it at face value, does it rise to the level of actively stalking an individual, destroying his career, having him fired from two major employers and directly contacting cons he was contracted to appear at and getting him cancelled via lies?

They still seem to think that this is Vic that is on trial and they can prove to the world he is this monster, because they decided he was a monster.

I don't think this is about outspending him financially. Unless Ron is making a hell of a lot more than any of us think, they don't have a $180k, and ever growing, war chest not even mentioning what personal assets Vic can bring forth. All the delays, lies about deals to move things forward, and transparent attempts at defaming him are to drain his emotional will to fight. Didn't one person say they hoped he killed himself? If you want to delay a case and, like Casey, apparently don't care at all about ethics or whether you get sanctioned, fucking around with depositions is one way to do it. Just disrupt and fuck up the deposition so its products are completely worthless, then drown the case in motion practice arguing about the deposition.

You can do this if like the vast majority of depositions, it's held in some motel conference room or law office or anywhere but a courthouse.

But Casey's genius maneuverings with the deposition dates led to a hearing where the judge himself decided he needed to babysit the proceedings personally and now, they're going to be held right in the courthouse, with the judge personally available at a moment's notice.

So if there's any fuckery, the judge will be right there. If the Soye Boye or Casey try disrupting the deposition or refusing to answer frivolously, the judge will personally order them to answer immediately. And if they continue in their contumacity, he can literally throw anyone there in jail immediately.

Credit where credit is due though, Casey, it seems, is trying to stick to the original gameplan. Depose Vic first before discovery is finished. File TCPA/prevent MoRon from being deposed (somehow) and try to shame Vic so hard that he drops the case.

We thought all that was shot out of the water when the Discovery Request deadline came and went, but as it turns out on Nick's stream it's mentioned the ONLY thing they delivered was a few public tweets, as well as the i09 article that was made as a hit piece against Vic. All the while saying "We'll give you the rest Later" which likely means they intended to file a TCPA before handing anything over.

Of course this is still giving them the benefit of the doubt that they -have- anything (which at this point it's pretty obvious they don't). Hell they couldn't even provide the investigation results, who was in the investigation, what was said in the investigation and so on.

At this point I'm just completely at a loss with how absolutely mind-bendingly stupid their entire defense has been. To Monica, Ron, and Casey: When your bluff is called, don't octuple down and swear "We GoT lOaDs Of EvIdEnCe GuYs, FoR rEaL!." Judges don't care much for litigants beating each other up outside of court but when some asshole lawyer stands right in front of them, looks them in the eyes, and flat out lies to their face, they get angry. They get vengeful.

I still think the Judge is going to throw a conniption fit on Casey. Casey stood in front of him and expressly argued that it was his and his clients position to not keep those "victims" confidential, and the "victims" were all in on it. He's not gonna buy this whole "things have changed" in 10 days. He's going to view this as two faced bullshit. and specifically as two faced bullshit committed to his face.

I would agree the judge wouldn't necessarily care if they made a motion for confidentiality HOWEVER Casey already placed a motion for no confidentiality, the other issue here is Ty clearly pointed out the issue with what Casey wanted within the "Rule 11 Confidentiality" agreement and stated that the court would put everything that needed to be redacted on the finale filing so there wouldn't be a need for anything added.

The flip flopping even though Ty AND Vic have not stated to attack anyone on the defendants side and then using the same reasoning that he himself stated was within reason to prevent a confidentiality order while also adding onto the fact that the kickvic side has been constantly using the context of the filing to pain the Plaintiff in a bad spot also points that a full redaction does not fall within Ty's and Vic's goal within this court case.
It's hard to understand a judge not just forcing the courts redacted ruling considering Ty already stated he'd only allow that; the real issue is the discovery answers where even Casey couldn't figure out what was wrong with them because it never followed the rules because they never gave him anything even 12 days after and apparently after Casey's own admission deadline.

I'd take a guess and assume the judge would be royally pissed at Casey simply because even after Ty allowed him to go over the deadline (dictated by law) Ty still allowed it and was even willing to negotiate when he never needed too.

Gotta say though, this has been the most entertainment in terms of lawsuit I've seen.

I know that generally you can only get deposed once in a case, but that the court can order a second deposition. How common is that? If Casey continues to play chickenshit games and in fact does not provide the interrogatories in a timely fashion before the deposition, how likely would the court rule that MoRonica could be deposed a second time after BHBH have a chance to review them?

I'd like to think it's an easy case to make, for that. Especially the way Casey's been acting, even in open-court. And, if it does come to that, it's likely MoRon will have to pay for the extra deposition time they were already entitled to, with the benefit of discovery.

It muddies the water that Ty and Casey agreed to the deposition times, but the last minute nonfeasance paints a pretty clear picture of gamesmanship on Casey's part.
