It's more complex than that.
Exhibits C and D (email chains between Ty and Casey) are very interesting, basically it reads like Casey wants JUST what he wants confidential and wants to be able to say THIS is covered under Rule 11, then Ty would have to object to court. It's not a broad confidentiality. Casey ALSO wants to be able to cover previously public info under this.
Ty (IMO) rightfully said screw it, see you at the motion to compel and we'll be seeking sanctions.
Casey said NuhNuh you didn't comply with discovery either because you didn't LABEL your stuff and that's hard.
So you have documents from Vic just unlabeled, and NOTHING from Ron/Monica and Casey is trying to do a 'you too' defense.

Maybe, but this case isn't as susceptible to delaying motion practice as many would be. All he's really doing is guaranteeing his clients ultimately lose. Their only defense is an affirmative defense and they either back that up with evidence or just flat out lose.

I love how he used the term "prophylactic" specifically to refer to their stalling bullshit.
Given the crap these lying bastards have falsely accused Vic of doing, I'm convinced Ty is doing an incredibly subtle shade toss with that wording.

Looks like it, everything spewed in the objections Casey provided basically amounts to the same BS douche baguette spewed “pro bono”
so either his clients are being exceptional and ordering super lawyer Casey to mimic super twitter Lolyers, or Casey is so out of his league that he’s taking non Texas lawyers advice and breaking local rules they have zero experience with.

Okay, I'm making the bold prediction that Casey is going to file the TCPA after Vic's deposition based on the ongoing faggotry in the emails. He's stalling hardcore and I don't see any reason for that to change. They just gay oped some rubbernecking lawyers to galvanize Kick Vic side and they will use his deposition answers to continue to do so.

I still think the Judge is going to throw a conniption fit on Casey. Casey stood in front of him and expressly argued that it was his and his clients position to not keep those "victims" confidential, and the "victims" were all in on it. He's not gonna buy this whole "things have changed" in 10 days. He's going to view this as two faced bullshit. and specifically as two faced bullshit committed to his face.

Judges don't care much for litigants beating each other up outside of court but when some asshole lawyer stands right in front of them, looks them in the eyes, and flat out lies to their face, they get angry. They get vengeful.

That's what I've always felt. There is no evidence to back them up, so their only option was to keep delaying everything in the hope Vic runs out of money and gives up. Coming to an agreement would be sensible, but Moron have shown they are anything but. Now they are getting backed into a corner.

I don't think this is about outspending him financially. Unless Ron is making a hell of a lot more than any of us think, they don't have a $180k, and ever growing, war chest not even mentioning what personal assets Vic can bring forth. All the delays, lies about deals to move things forward, and transparent attempts at defaming him are to drain his emotional will to fight. Didn't one person say they hoped he killed himself? They still think they can push this far enough and long enough that he will just roll over and give up. I don't watch chinese cartoons and have no desire to delve into the scene, but it looks like Vic is getting support from the community; especially from fans and in person where it can have the most positive impact. Hopefully enough community support, along with personal support and his faith, to see him through this.
It still has to be draining as fuck though. I've had a lot of sleepless nights in my life and I imagine he's been having a lot himself the past 6 months. They know him better personally than anyone here or any of his fans do. They knew how isolating him and having everyone turn against him would destroy him. They probably have a better idea how much fight he has in him. Thankfully they underestimated how much the community loved him and never anticipated that love being mustered into support.

I've tried to rationalize their legal strategy and the only thing I could come up was this... They wanted to win the court of the public, not the court of law. Try to imagine how things would have played out if Ty didn't confront Casey about the deposition TCPA plan. Vic would get deposed, likely concerning gossip issues like sexual partners and instances of cheating, and that would be the message the case would leave for a 2-3 month period. All the youtubers covering the case like hero hei and yellowflash would move on to other controversies and likely only nick would have come back to the case once the TCPA was beaten. The public at large would have largely forgotten about the case and Vic would only have the reputation his opponents gave him.
That's whats at stake here for Casey. He knows the case is a lost cause, but if it comes out that his clients are liars while the majority of the public is watching, his clients will lose everything and be unable to find work in the industry or cons. So he's stalling. These shenanigans with confidentiality with this perspective in mind make more sense. "Welp, I can't prevent Vic and Ty from getting evidence before slowing the case down with the TCPA. My best bet now is to get him into a confidentiality agreement so that he can't talk about that evidence." He wants his side to appear in the right before shutting down discovery and losing interest for the majority of folks watching. Because at that point, it won't matter if he wins or lose. His clients will be able to find some work.

Which he is voicing for the first time, and which opposing council is clearly willing to rectify. Ty/Vic did turn over the requested information. Casey is bitching about the lack of easy cataloging. Oh and for those that missed it, his major complaint about not being given the full text stearm... it's his clients text conversation. His client shared the materials with Shame, and validated them publicly.
