:story: 250 bucks! Nope, it definitely won't be Gaiman.
Zack mentioned this in one of his funniest bits this week; he compared a rich dude like Neil Gaiman (~$16m) donating $250 to a regular guy giving a penny for your cause.

I've always wondered and would like to ask for updated thoughts about Marvel being dragged into this mess, as i think everybody could agree that Waid would open his phone call with 'I'm Mark Waid from MARVEL...'. So given the recent information and events, how likely do you think discovery of Waid's Marvel emails / activities occur and potential evidence of civil conspiracy or more is found?

At this point I expect the lawsuit to survive jurisdiction and TCPA challenges. Will Zaid finally step in and do anything? Maybe he can start with settlements to protect Marvel.

At this point what everyone is drooling for is what discovery will unearth, Waid is die hard enough to ignore any pleas from his non-Super attorneys.

I still think he'd be crazy to poke the bear mouse. Just hit the easy target and enjoy the salt from his followers. Getting competent lawyers involved in the defence just draws everything out and if you think Waid is throwing defences/motions at the wall to draw it out you haven't seen anything compared to the mouse.

I know Disney will vigorously defend itself to put it mildly, but Marvel Entertainment is not Marvel Studios. It's the retarded stepchild you had to accept as a package deal in order to marry the trust fund supermodel. Could they use this as an excuse to smack Perlmutter on the nose with a rolled up newspaper and clean out the company? Disney doesn't give a shit about comics. They just need the IP. Perlmutter has been a source of constant embarrassment due to all of his retarded scandals and Disney usually keeps quiet about it. A lawsuit about how Marvel/Disney is trying to ruin comicbook artists and small publishers could be a great story, especially when a judge rules that calling Meyer a Nazi is defamatory and he has a defense against that narrative. Put pictures of his bi-racial kids next to pictures of him in his blues. Not that the stories would likely have an impact on MCU profits, but Disney hates having its name drug through the mud.

There's all kinds of faggotry at play here.

Definitely. Waid has already shown himself to comically arrogant and sloppy in his attempts to sabotage Zack. He’s worse than the bank robber who immediately hits the pub and starts bragging about his crime. Waid practically left a signed and notarised confession in the vault.

Waid's pathetic facebook rant convinced me there's some skeletons that are about to come out of his closet.

It means Waid is a complete and total idiot. And he apparently just broke a confidentiality agreement with Meyer and Byrne. The only parts of the deposition we have seen were those included in the filings so far. The rest was supposed to be kept private by agreement.

I really feel for this shitheads lawyer. Judging by the quality of Pierces most recent filing, you sense a deep “don’t give no more fucks” with regard to his case and client. Can you imagine trying to represent and advise this unhinged man baby?
Does this mean the Judge could order the release of the full transcripts if Meyers lawyers request it? Assuming of course there isnt anything damning for Meyer in it.

You think they will even bring it up?

I agree with your assessment, however would you like to try and take on the mouse's lawyers? Much safer (plus funnier) to nail Waid for his actions rather than Marvel for their employee's actions.

Someone feel free to correct me but I think you would have to prove that Waid was acting as an employee of Marvel and not as himself at the time of the interference. If he never outright tells them about his position or any repercussions coming from that direction it could be tricky to prove (especially since that would be Marvel's best way out of it, throw Waid under the bus). We can see clearly there was an implied threat but we're talking getting a judge to know the first thing about comics and why Waid would be well known.

Now the fact he is still working for them after taking action to try and shoot down a competator (for any reason) speaks poorly of them and their business ethics, but who doesn't know that the mouse runs a pseudo-monopoly by now?

A question for those more versed in law than myself; if this all goes Meyer's way as it should does AP have a cause of action against him for the money they lost by not printing the comic after Waid's interference (and those of the minions he sent to dogpile)?
He doesnt need to. All he needs to do is bring it up during testimony and Marvel will cringe hard at even being mentioned. Waid will never work for Marvel again at that point.

What is really sad is that Marvel is BARELY keeping AP's lights on. Let's not forget the email Joe sent Zack saying that he (Zack) made more on Jawbreakers in ONE DAY than AP made in a year. I hope that haunts Joe forever.

EDIT: Added the email, because I couldn't find it posted.

I actually might have to think about getting into Gold Digger again after this.

Wasnt there some talk about audio of the actual phone call Waid made to Ap? Hope he didnt actually say "from Marvel." That would mean hes acting on authority from Marvel.

I hope this discovery was just to get Waid to commit to something so that he would perjure himself to death with everything theyve got on him later.

You miss one hugely important detail, normies and casuals just know Disney owns Marvel and generally don't give a flying fuck about the minutiae of Disney's compartmentalization of it's properties.

Waid's pathetic facebook rant convinced me there's some skeletons that are about to come out of his closet.

I suspect one of the bigger skeletons in Waid’s closet just got paid off in the form of sudden employment in the industry, after years of being left out in the wilderness. Does anyone else think Devin Grayson has some stories to tell? Just from what we publicly know about Waid. Stuff that can be proven, no question, he has a long history of emotional abuse and borderline violence to those around him. Objects get flung and smashed. Walls punched in. Etc. This shows up in the way he attempts to gaslight AP like an abusive lover. “He only hits you because he loves you. It’s for your own good”. He’s clearly an abuser. Don’t you think his ex’s would have some interesting stories? And remember he tried to paint Meyer as some sort of PTSD suffering violent nut because of his military service.

Does this mean the Judge could order the release of the full transcripts if Meyers lawyers request it? Assuming of course there isnt anything damning for Meyer in it.

The Judge doesn’t have to order anything made public. Anything filed with the court becomes public. There was a gentleman’s agreement between Meyer and Waid’s legal teams to limit public release of deposition and discovery materials to just what was needed for their filings. The agreement is common and was largely to Waid’s benefit. Waid like so many other instances, fucked himself with this one.

As for Marvel? They have to be cringing hard and getting alarmed. Some recently revealed communications make it clear that at a minimum AP’s principals felt that Marvel was an implicit element of the threat. It was in some way communicated to them that should they publish Jawbreakers the likely outcome would be any of AP’s associates and contractors being denied further industry work by Marvel. This came up immediately after, and with regard to unsolicited conversations with “Marvel’s MarkWaid”. It’s pretty obvious that the Dunn’s viewed the threats as legit, and that Waid or other parties involved had the ability and influence to do things such as deny AP affiliated colorists work. Add to that the mysterious “Joey” who appears to be an AP contractor/former full time employee, who’s own coloring business works directly for Marvel. To further add to this the appearance is that much of Waid’s legal defense fund was funded by Marvel employees and contractors. With some rumors indicating a certain degree of coercion from management encouraging contractors to donate. Some of this may go as high as Tom Brevoort. Plus there is a tertiary question that I am sure a lot of people would love to ask underoath. “What is Joe Quesada’s relationship to Renfamous and SJWSpiderman?” Because there clearly appears to be one.

We now know that the threat perceived by AP was that their associates would be denied work from Marvel. Where did this come from? How did this enter into the equation and thought process? This isn’t something the Dunn brothers would just pull out of their asses without some actual implicit or explicit threat. Which leaves Marvel in a dangerous place of exposure. Certainly Marvel Entertainment likely did not have an overt corporate policy regarding Richard Meyer. It’s likely Ike Perlmutter has never heard his name. But the takeaway impression is senior management has long ago lost control of the public activities of their middle management and general employees. These lower tiers are acting in ways that have the strong possibility to place their employer in legal jeopardy. Because nobody is paying attention, and nobody is enforcing the rules of proper and legal business behavior on them. They have people acting implicitly or explicitly in Marvel’s name that have no business doing so. This is exactly the same situation as with Funimation over in Weeb Wars.

God forbid Alan Braverman has to get involved...

Order Referring Motion

Probably just assigning the motion to a magistrate judge for a ruling.

I'm sure that if I ever end up in court I'd be glad the system moves so slowly and deliberately, but sometimes it's hard not to wish it moved as quickly as it does in TV law dramas.

Whenever the magistrate rules on it. I'd guess in about a month. And then there will be time for the defense to challenge it when they lose, which they might do just to waste everyone's time. And then the main judge will be forced to rule on it and will almost certainly adopt the magistrate's opinion. That might delay it some more.

Then there's the TCPA motion.

I think everyone is assuming that Marvel isn't /wasn't fully on board with Waid's BS with AP. Considering Joe Quesada's nerd-on with Renfamous and Zak's many videos exposing the milkshake girl BS and various woke doings with characters, they may well be at the root of it.

I think it's more likely than not that they are very much involved at a deep level. And I still say that before all the comics/weebwar shit is over, there will be RICO because a lot of this is very much organized and criminal. And RICO does not require mafia for use.

But aren't these depositions mostly for the jurisdictional arguments? More details would come out once it's settled which state they'll proceed in.

I assume ....

Yes. Those were for jurisdictional and thus were limited. Zack said there will most likely be more depositions when the real trial stuff starts. Hopefully the jurisdictional issues will be over in 60-90 days.

It IS. One of Waid's ex's was quoted talking {bullying} a small indie shop YEARS AGO about firing one of the owners when the store was bought. She said Mark has millions and will drag you around court for as long as it takes. He actually thinks he'll outlast this, if not that he's actually totally innocent
