Yeah I agree. Honestly if it came to that, Josh should hang it up. There isn't any "beating" a company like Cloudflare in court. The amount it would cost would be so astronomical it isn't feasible.

I am curious though, is there a way to mitigate DDOS by just having the landing page to the site be a login and only letting existing users even visit the main site at all? I really don't know enough about how it works to be of much help, and this seems like a very obvious thought so I assume that isn't a real solution. But I do know we always have lurkers and "guests" here and maybe we don't need to most of the time. Maybe the solution is to only let users in and then change how new users can join (maybe the only way to join is via an email after which an account is created for them or something).

We have evidence that they've been informed of these sites. Support tickets, correspondences with technicians, etc. The legal strategy isn't the problem. It's the fleet of lawyers they have on their payroll.

The legal strategy is kind of the problem. Unless they get an absolute retard in, any lawyer could very easily spin the narrative that KF is high profile so CF was justified in how quickly they acted, and the actually harmful sites slipped through the cracks. They probably do have evidence that they're swamped with reports of illegal or degenerate websites and content, or requests from law enforcement to keep websites up for monitoring/digital forensics purposes.

Remember, this would be a civil case not a criminal one. You need to seek compromise, not justice in cases like this.

Literally this. Have the clearnet site just be a static page telling you how to access the tor site with links. Let them DDOS nothing hosted on literally the cheapest hosting services while the actual tor site is up. There are a bunch of other alt networks that are censorship resistant too. The clearnet is gay and outdated anyway. It doesn't have any mechanisms to defend yourself from these types of attacks unless you're rich.

EDIT: Jackasses I'm not saying he should do this. I'm saying if he has to do it. Obviously just being accessible from the clearnet would be preferrable but alt networks like Tor (among others) are a good option. Just having the static clearnet page up explaining how to get here is great for onboarding. The clearnet is fundamentally broken and it's not going to be fixed. nah you are right to a degree. the usual suspects attack most around those times. but those attacks usually only last a week or so or can be dealt with in one way or another. these larger attacks are entirely random and far more organized. that or there is someone out there who has been doing nothing but working on creating the biggest botnet possible.
