The appeal means there's going to be a precedential opinion in the most influential Circuit on IP law (the Ninth). There are two broad categories of result.

One is it's upheld. In that case, reaction videos are practically unassailable (fun fact the opinion cites Stebbins for the reaction video reasoning).

The other is it's sent back. Then we get to watch two retards fighting some more.

Tbh I really doubt he cares if he wins. At least not that much. His purpose is to bleed them. So now he gets to appeal it and federal appeals are insanely expensive.
 
Can someone explain to me what made the Denims lolsuit different from the other lolsuits? Did he win against Frogan and that other stoner girl on merits or did they both back down and settle?

It's mostly just that she fought back. Kaceytrooon was broke, Frogan basically didn't raise enough and most likely ate whatever she did raise. But from what I have seen, the reaction ratio for Frogan is similar to Denim's, so imo, the Frogan lawsuit wasn't a slam dunk for him either if it went to trial.

But none of these lawsuits were meant to go to trial. He wanted to use his money to shut down any criticism, so he hoped he could get a Kaceytron-type settlement for all of the lawsuits. Denims in the meantime, saw her audience grow substantially (I never paid attention to her before this lawsuit, but that's what I've been told), raised more money, and hired very good lawyers.

Ethan lost the moment he faced any actual legal opposition. Lex Jewthor indeed lol.


Everyone knows that Ethan doesn't give a shit about copyright. It's just basic slap-type lawsuits, but using copyright instead of defamation. Some still pretend that somehow they only side with Ethan because he is doing this to save us from streamers broadcasting and stealing Disney IP (lol, lmao even) , but it's mostly thinly veiled troll shielding.

Honestly being wrong in this case is completely fine. What I'm perplexed about is the people who are still in complete cope mode and "not even wrong", second guessing federal judges because they would rather believe a dumb retarded podcast host. Like even Pisco, one of the very few law adjacent streamer who got sided more with denims, was still wrong about the infringement part. That's completely fine. Ethan really is a good liar, though personally I have found him repulsive since 2018 ans never believe what he says, but I can still see that he can be convincing and very PR minded.

His lawsuit was eye candy and he kept repeating the same points about malice, intent, and showing clips that were beyond misleading, to the point where it was hard not to think that he must have a very solid case. Watching denims for 5 hours is super unpleasant, so the clips he showed where she supposedly didnt talk for long stretches of time, or barely reacted/left looked damning. So as an outside observer it was perfectly normal to think ethan would destroy her

But if her stream, that imo added a lot more quantitatively than most similar content (more than even most famous pausefests like the Casino), was ruled to not be fair use, it would have raped tons of actually funny youtubers and streamers. So it's a win-win.
