I think he has made a smart application. If he had asked for outright custody the judge would have shot him down. Asking for 50:50 means he stands a chance of actually getting it. Once this has been established he can then push for full custody later on.
@Jimmy Dean Bowl I totally agree. I was actually impressed with how mature and complete that agreement is considering the sources for the material.
He does give Alex a chance to potentially play some shitty games if she ever wanted to move jurisdictions by allowing her to establish residency for the child as part of attending school. That is also the only thing that makes the potential revision harder because the court will ask him why didn’t you ask for whatever custody originally and allowed the mother to establish the child’s home.
In my state, there has to be a material change in circumstances to petition the court for a revision to the parenting plan. Unless Alex really fucks up, she’s got primary.

Gross post about breaking the cycle. As a reminder, Alex did NOT leave Florida because of "abuse." She left because she'd been charged with inappropriate conduct with a minor. She didn't flee abuse; she FLED PENDING CHARGES.

The kid was living with Alex's parents until homeless Alex was very kindly taken in by Noah's parents. She was booted out of their home after she got Noah charged for "abuse" and ran over Noah's mother with her wheelchair.

And then we have Alex, who is here to treat us with a wide assortment of police reports for allegations that were never substantiated, charges that were dismissed, screenshots of text messages, and more. Her witness will be Salina, aka instathot.

Once again, I do not like Noah. However, I think his court case filings are coherent. I certainly think it would be great for Ari if he got his act together. I think Ari is far better off with the Smiths than with Alex's family. And I also think Alex doesn't have much of a prayer of keeping Ari fully away from Noah, since her evidence appears to be "trust me, bro."
ETA: I just noticed that she made the report of the alleged rape in March of THIS YEAR-- in other words, only once she knew that Noah was fighting for shared custody. Good grief.
ETAETA: ALSO, she acknowledges that she was passed out drunk with Ari in the room when this happened. And the person who supposedly had the video only supposedly recognized them by their voices, AND told the cop that Alex was more upset that Noah was talking to other women. The officer who wrote this report is a real master of strategic quotation marks.
ETAETAETA: also, as they point out on Reddit, Kelly says Alex was drunk when she talked to her. However, their conversation occurred in a time that Alex was supposedly sober.

We rarely give people the benefit of the doubt here, and with very good reason.
However, they say the brain doesn’t mature until late 20s and longer when on drugs. But it seems like Noah has finally matured, is off drugs, and ready to be a parent. With help at first but maybe on his own. Good things can happen. His filings are very reasonable. He clearly and honestly loves Ari. Even in the worst of days we could all see they had a connection. Alex sucks for not fostering it.
Since Ari’s choice is a violent drunken family (note how Alex never states her parents are sober) or a possible sober young man with definite sober and loving parents, I’m hoping Noah gets everything he asks for (he will) and if it works out, then his plan is to go for full custody in a year.
Filing a rape charge years after the fact is so transparent and there is no family judge who is going to fall for it. There are so many videos of Slex that belies the fact that Noah raped her.
My hope is Noah has grown up. It does happen. I want to be optimistic in this one case-we see so many kids on this site wronged…
But he is still a druggy mess, the Smiths are better than the Dzimowitzes or however it’s spelled. They aren’t hoarders but they don’t even have a room for Ari or don’t think she needs one. They just bought her a bed and no evidence that they aren’t drinking either. They might not be calling the cops because of this case-that doesn’t mean there isn’t screaming and yelling going on still.
I wish Noah had asked for more as the judges rarely if ever give more than asked for, but it’s a start for him. One mess up by Alex after he gets 50/50 and he can take her back to court.

I really hope that Noah comes to understand that living well is the best revenge, and that part of living well for a parent is keeping your child offline. The best revenge against Alex in particular would be to keep Ari off the internet the entire time she's with him. Document everything in case Alex makes things up (or coaches Ari) later, but save it for family court. Keeping Ari offline would truly demonstrate that he has her best interests at heart.

I genuinely don’t understand how Alex continually denies Noah his right to contact with Ari based on her supposed concerns that he will violate her privacy, while she also plasters her all over the internet all day every day. She made the kid an instagram account, for fuck’s sake. Ari has no privacy and it has fuck all to do with Noah. Alex is an evil goblin and I hope the judge grants Noah every (very reasonable) thing he’s requested and then some.
