November 20, 2024 was, I believe, when the leaks happened. Before that, his thread was about 950 pages. The OP dates back to March 16, 2017, meaning it took 7 years and 8 months to reach 950 pages. As of today, this cow’s thread sits at 2,242 pages, a staggering jump of 1,292 pages in the span of only 1 year and 6 months, 18 months total. That is not just the same old posters recycling content. That is outside traffic coming here to read the analysis of our farmers and also participating. And this happened despite Destiny having a full online and real life support operation, plus connections in tech that help shield him. Case Overview
Nature of the Claim: Plaintiff alleges a violation under the Civil Remedies for Illicit Disclosure of Intimate Images (CARDII) Act.

Deletion of Witness Communications: The Defendant deleted his side of Discord communications with the Plaintiff and at least four other relevant female witnesses. He publicly admitted on a livestream that he ran a "whole redact" of his Discord after being put on notice of foreseeable litigation.
Destruction of Media Links and Files: The Defendant transmitted multiple Google Drive links and media files to a non-party witness ("Abbymc") in 2023. One text accompanying a link on May 5, 2023, asked, "Did I ever send you the one of her blowing me?". These underlying Google Drive links are now dead, and the files are destroyed.
Fabrication of Evidence: The Defendant submitted a self-prepared "true and correct log" (Exhibit E) of files sent to Abbymc, but the Plaintiff proved it was demonstrably false. The log omitted the critical April and May 2023 Google Drive links found in the actual chat logs. Additionally, the Defendant admitted on a livestream that he was "artificially creating a file by reconstructing a log" because the original information was lost.
Forensic Unreliability: The Plaintiff’s forensic expert, Jesús Peña, provided an unrebutted report concluding that the Defendant used non-native tools that stripped metadata, failed to generate cryptographic hash values, rendered files unrecoverable, and manually reassembled Exhibit E (evidenced by a 10-hour timestamp offset).
Refusal of Examination: The Defendant refused the Plaintiff’s proposal to undergo a neutral, narrowly scoped, third-party forensic examination.
Legal Arguments
The Plaintiff argues that all three preconditions for sanctions under FRCP 37(e) are met:
Duty to Preserve: Attached no later than November 29, 2024, when public leaks occurred making litigation foreseeable, and was reinforced by a preservation demand letter and warnings from the Court.
Failure to Take Reasonable Steps: The Defendant did not institute a litigation hold, generated no forensic data, and actively deleted records.
Irreplaceability: The ESI cannot be restored or replaced through additional discovery because fact discovery is closed and the Defendant completely deleted his side of the files and communications from the native platforms.

Relief Requested
The Plaintiff requests that the Court impose the following severe sanctions under Rule 37(e)(2):
Strike the Defendant's defenses and enter default judgment in the Plaintiff's favor regarding liability.
Alternatively, find that the Defendant intentionally spoliated evidence and issue an adverse jury instruction. This instruction would direct the jury to presume that the destroyed Google Drive files transmitted to Abbymc in 2023 contained the unconsented intimate recordings of the Plaintiff—thereby proving a post-CARDII transmission as a matter of law.
Award the Plaintiff reasonable attorneys' fees and costs associated with bringing the motion.
