The idea that a tenant being evicted for non-payment (and who admits to non-payment!) should get any benefit of the doubt that they're going to properly pay during the appeal is a good example of why it's a nightmare to put personal property or rooms up for rent. Oh, he can be noticed for eviction again? $250 for another appeal is cheaper than a lot of housing options.

Most rental agreements have fee shifting for anything the landlord had to pay out of pocket.

Anyway there's always a right to an appeal, and the reason for a bond staying the proceedings is otherwise you could never appeal an eviction. One guy would make the final decision and if it's totally wrong, there would be no possible appeal, because the issue would be moot.

This isn't a normal appeals court appeal, but a trial de novo, much like you can appeal a small claims court decision to an actual court. It's basically a rerun. In some cases, a trial de novo is just based on the written record, but apparently this kind in Nevada is a rehearing.

It's not likely to take long.

In Nevada, State District court appeals go to the Supreme Court of Nevada, not the Appeals court. It's one of those states.

Skipping a level of appeals is fairly common in these kinds of courts of limited jurisdiction or administrative agency appeals. A federal example would be that immigration appeals go straight from the administrative agency to a Circuit Court of Appeals.

He’s parked his ass in this man’s condo and not paid December, January, February or March rent, but paid $250 on this Hail Mary appeal, the basis of which appears to be that he feels the entirety of the rent owed should be offset because he was chilly one evening, his landlord walked into his room at midnight, and there are comparable units renting in the same building for cheaper.
Surely even room temp IQ Russ realizes that he isn’t going to be allowed to live there beyond this next court date + a few days, right? I can imagine he’d believe his debt would be magically erased, but not that he’d be allowed to live there any more.
I wonder if he is so desperately fighting for this free roof over his head due to a lack of any other option.

It’s a short term month to month agreement presented to a renter with a recent history of evictions. Why wouldn’t it be enforceable? You will probably find the same or similar language in every hotel and Airbnb agreement.
