If he did then claim then he may get away financially but would be spending some time in a facility or at the very least under guardianship.
A plea of temporary insanity wouldn't fly as this has been dragging on to long.
Depends what state he's in as well, some states require the defence prove insanity others the prosecution is under burden to prove sanity.

At the rate this is going, it's going to be in a jail cell within days.
