Section 301 of the Trade Act of 1974 is used if there are unfair trade practices going on under a trade agreement. We can tariff in response to violations of a trade agreement. Trump could get away with placing tariffs on Canada and Mexico if he found them violating the USMCA.

Trump is not using that law with his tariffs. He is justifying his tariffs under the International Emergencies Economic Powers Act, claiming that the power to block transactions and freeze assets during an emergency allows him to create tariffs. This is what the Supreme Court case is about, by the way.
