There's a rule (FRCP 68) that if you unreasonably refuse a settlement offer and don't get more in the judgment than you would by having settled, and you are otherwise entitled to fees, you could have those fees reduced or eliminated entirely. So you could conceivably "win" your lawsuit and get a judgment, but end up losing monetarily anyway.
