“FCC Section 73.1217 of the Code of Federal Regulations (CFR) addresses broadcast hoaxes and prohibits any licensee or permittee of a broadcast station from disseminating false information about a crime or catastrophe if they know the information is false, if it is foreseeable that the broadcast will cause substantial public harm, and if the broadcast in fact directly causes such harm. Substantial public harm is defined as immediate, direct, and actual damage to property or to the health or safety of the general public, or the diversion of law enforcement or other public health and safety authorities from their duties. A "crime" is any act or omission that makes the offender subject to criminal punishment by law, and a "catastrophe" is a disaster or imminent disaster involving a violent or sudden event affecting the public.”
