(WJAR) — Rhode Island’s attorney general is still weighing the professional punishment for one of his prosecutors caught on a now viral body camera video being arrested on a trespassing charge in Newport last week.

Peter Neronha said Tuesday Assistant Attorney General Devon Hogan Flanagan will face an unpaid suspension, if she’s kept on.

“I’m an AG. I’m an AG,” Flanagan is seen repeatedly saying in the video released by Newport police Monday, as officers gave her and a friend chances to walk away after a restaurant wanted them out.

They got arrested instead.

“Buddy, you’re going to regret this. You’re going to regret it. I’m an A,” Flanagan said as an officer shut the police cruiser door with Flanagan inside, before she could finish saying “I’m an AG” for the 12th time during the incident.

“I think it’s alcohol related,” Attorney General Neronha said on WPRO radio Tuesday with Gene Valicenti.

“I have to give it some more thought, but inexcusable behavior,” Neronha said of the potential punishment for Flanagan.

There was no answer at Flanagan's home Tuesday when NBC10 went seeking comment, the same as Monday, after a woman who answered Flanagan’s phone number Monday told NBC 10, "no comment."

Neronha said he met with Flanagan Monday and had her watch the body camera video of her arrest.

“She’s really remorseful. She takes responsibility,” Neronha told Valicenti on the radio.

In the video, Flanagan tells officers multiple times to turn off their body camera.

“The protocol is, your protocol is, if I ask you to turn off the body cam, you have to turn it off. That’s your protocol,” she argues at one point.

Flanagan's attempts to get officers to shut off the body camera were wrong, says Nerhonha, whose office wrote a statewide body camera policy.

“I’m not sure what she was thinking. Clearly she was not thinking straight,” Neronha said.

As for what happens next with her job, Neronha said, “It’s just hard to find and keep capable lawyers. And I just have to think really carefully about this one. But no question there will be a strong, strong sanction here.”

“There will be a suspension without pay, if I retain her, for sure. So she’s not going to continue as if nothing happened,” Neronha told Valicenti. “She’s humiliated herself. Regardless of what happens vis a vis her employment with us, she’s going to have a long time coming back from this. It’s just really unfortunate.”

Neronha said Flanagan would apologize to Newport Police officers.

At the attorney general’s office, Flanagan argues cases in front of the state supreme court.

Her salary is $113,000.

i found the situation hilarious, having said that she was outside the restaurant and apart from being an annoying whiny asshole was not impeding anyone else using the the sidewalk or the restaurant so probably could have just been told to STFU a bit more and the male friend would have taken them both away. Being an asshole in public is one thing, trying to abuse your position in government definitely needs to have consequences. IDK that losing your career is a measured response to it, it seems then the learning experience of how to take your role seriously and not be fucking stupid when you are in a position of authority will be wasted. People need to be able to make (non lethal) mistakes and learn from them without total execution of their life. It's not like anyone died over her bullshit, even the cop wasn't really that annoyed just kind of tired of listening to it.

I, ANAL. But if you're being trespassed it's not a good idea to hang around. It looks like the restaurant owned what she was standing on because they had an outdoor table right there.

After the spergout, there are many charges the cops can cite, like disorderly conduct, later resisting arrest. Being detained briefly inside a cop car and then being set loose is also a real thing that can happen, and they almost got that courtesy. She was given chances to exit the situation but the alcohol brought out her inner authoritarian girlboss mode.

Being an asshole in public is one thing, trying to abuse your position in government definitely needs to have consequences.

I for one am glad this is getting nipped in the bud. The type of public official that wants special favors and behaves like a pig in public at this stage of their career is bad news.
This kind of thing will set her up very nicely for divorces and traffic tickets. Let’s see if she can handle that level of responsibility.

yes the situation could have been resolved easily if she stfu for 30 seconds and stopped trying to be in charge, 100% agree, also agree she is in the wrong and made a fool of herself trying to do the big I AM. I think she will hopefully learn a lesson from it and stay in post. My reasoning is it is better to have people who have had humbling experiences working in these positions so they can relate to the people they exercise authority over instead of people who think they are perfect and anyone who isn't can get fucked for being a failure. We need real people with real lives in any job we interact with, not remote elites who have zero fucking clue how the real world is.

She's a lawyer. She incorrectly stated law and procedure to police officers: incompetence, why should she still have a job or even a license? She attempted to use her position to avoid normal legal consequences: corruption, why aren't they looking for charges to heap on and bury her with?

As other have alluded to, the corruption implied by "do you know who I am?" has far greater consequences than just the trespassing and resisting arrest. That wouldn't hold up in criminal court obviously, but losing her job over it seems totally appropriate - people who abuse their positions should lose those positions.

because non lawyers talk shit to cops every day of the week when they are drunk, and quote non existent laws. she was drunk and being an asshole, and should get some comeback for that, more than the normal person because she she ought to know better. but nobody died, nobody was even prevented going along the sidewalk or into the restaurant, what is the loss here? she annoyed some cops who were clearly tired of her shit which is understandable, a reminder of reality was very appropriate. but she didn't actually engage in any corruption or abuse of power, she merely ranted about it during a drunken rage.
like if she actually tried to use her position to retaliate or fuck with the cops for arresting her, then of course she should be axed immediately. but i don't think it was that serious, it was just the booze fueled ramblings of someone who had a couple more martinis than she should have.

The issue is that if she'll pull out "I'm an AG" to try and get out of being trespassed from a bar, do you think she has the scruples or self-control not to do so when there's something bigger to gain?

i'm assuming she is not drunk at work, so there will be some restraint in her ego. if she is drunk at work and ACCEPT MAH AOTHORATAAY then yeah ofc, busted down to walmart jobs.

i've told many truths when drunk, but I don't do that at work. also, I'm right, she was wrong, but she didn't know she was wrong because her ego overwhelmed her. women react differently to alcohol, unpopular opinion so shoot me for it, but this is a great example.

Translation - we'll wait until the outrage has calmed down and then we'll all just carry on and it will be as if this never happened. After all she's one of us and we're special. We're better than you.

Her job situation in a year's time will be exactly what is was a month ago save she may have received promotion.
