No that's only with civil cases, with criminal cases and especially in this case where I believe its likely a federal crime they don't need the parents or the victims consent they can just pursue charges. The only way he gets out of this is if no one reports him to the authorities.

All the feds need to do is find rose to confirm her age which blav and turner already did most of the work for, then subpoena discord, and they will hand over all the information which will confirm the messages where sent.
