Other countries can and will deny him entry due to his record already(why Korea didn't to begin with... who knows). For the US to actually revoke his passport, he would need to be a fuckup a couple orders of magnitude larger than he currently is and go through an entire process in the US for that to happen(which isn't likely).

I don't really see that working here. He chooses to get drunk and go commit crimes. Otherwise you could just drink a bunch of booze and go shoot someone you intended to shoot anyway and then get a lesser sentence.

An example where (here) it might mitigate to some extent is something like you went to a bar and exchanged blustering threats with some other guy. However, the state of intoxication of the people involved made the actual credibility of the threats low. In most cases not involving a cop you wouldn't even see this prosecuted.

I'm amazed he hasn't fled the country yet. I'n sure part of the long trial is their hopes that without the safety net from hanger ons he starves to death in the street without a source of income and spares them needing to actually jail him.

My guess is he gets 1-2 years though before they send him back. Long enough to serve as a warning to others.

How would he? He's banned from travel, likely doesn't have his passport in his possession, and where would he go?


He can't go north, that's a heavily guarded border. Fleeing to Japan even if he could get a boat wouldn't accomplish anything other than ending up sent right back. China actually enforces their borders unlike some western countries so that's not going to work. And he doesn't have the money to be able to pay anyone to smuggle him out anyway and it isn't like he can swim the 100+ miles to Japan who again would probably just send him right back.

Looks like it's up to the prosecution to argue that he intentionally incurred mental disorder "in anticipation of danger of a crime", whatever that means, otherwise that article applies. (Edit: assuming he was really intoxicated)
But I don't know law or Korean.
Though there's been a couple of high profile cases in which violent criminals got lower sentences due to being drunk, even when they had a history of committing crimes under the influence, like this guy.

Edit2: Browsing around Korean sources some say this has been tightened to punish drunk criminals more in the last few years, but I can't tell how widespread that change is and what sort of crimes it applies to. They mostly talk about drunk driving.
