In order to answer your question I made this timeline of the events in the case. I based this off of the filings and readily available information. Abbymc isn't even a part of the video getting uploaded to the Kiwifarms. We can also see from this timeline that the video was uploaded to various porn sites only after it was uploaded to Kiwifarms.

It goes: 1. Destiny uploads the video to Google Drive. 2. He makes it accessible to anyone with the link. 3. KF user @SoloTinyLeaks gets access to the publicly available Google Drive because Destiny didn't keep it private. 4. User @SoloTinyLeaks uploads the video to the Kiwifarms. 5. Someone takes the video from Kiwifarms and uploads it to various porn sites.

Abbymc is just more evidence of Destiny sharing the Google Drive past the deadline set by the statute and the text she sent her friend proves that she somehow knew about the video in 2023 meaning either Destiny or someone else with the Google Drive link gave it to her.



I tried my best to line everything up and make it as big as possible so you could read it easily enough. You may need to download the timeline and zoom in if your eyes are bad. Graphic Design is NOT my passion.






Also while the Timeline proves that the video was only uploaded to the porn sites after it was uploaded to the Kiwifarms I decided to look at the metadata to see what I could find.

Sadly no giant red flags saying the copy of the video on the porn sites came from the Kiwifarms, but if we compare the metadata for a recent Bossman video posted yesterday as a benchmark for how Kiwifarms, the website, affects metadata and the metadata of the video on pornsite notfans.com we find that they are EXTREMELY similar. Keep in mind I'm not a web developer so I don't know precisely how this works but, the FFmpeg libraries used for compressing and encoding are the same and a lot of the general metadata is exactly the same. I'm assuming that the porn-site didn't edit portions of the metadata which it appears it did not because the version of the libraries in the metadata for the pornsite video is older and consistent with when the video was uploaded to Kiwifarms.

Again remember that I am not a web developer and I don't know precisely how websites edit metadata for videos or what processes edit that metadata. But the metadata does look incredibly similar.

In terms of "continuous disclosure," which is the term they're now using (glad they went with an even broader term), I don't think it should matter much: Destiny uploads a file, the file is openly accessible, and has a shareable URL. Hopefully the elderly judge can have some sympathy with people being tech illiterate.
