Is Patrick Melton dumb enough to pursue a flame war with @Potentially Criminal? It wouldn’t end well for MAPton, so I sure hope so.
Melton has added Lawtubers Sean, Nate and Kurt voices to Supertips. So yeah, he is indeed dumber than any of us could have hoped.

Did he also add their likeness to Supertips to make sure people understand they are using Sean, or an imitation of him, to read the message?

@Potentially Criminal I know we all know the answer already, but did you per chance sign a contract with Supertips that allows them to use your likeness?

[EDIT] I wonder if Melton ever checked out NRS 597.790. The state of Nevada has some very enlightening laws.

i've always thought to myself that there is this long shot TOS violation that YouTube could enforce, and totally ban anyone who uses Supertips

I'll openly admit that my hatred for THE QUEEN!! makes me blind to the fact that that might just be wishful thinking

However, am I wrong- is there a TOS violation with people who use supertips to skate around giving Google, or Apple it's cut by not using a traditional YT Supertip

There is if YouTube says there is. It’s not complicated.
I think the TOS allow room for the interpretation, since it has a clause about harming Youtube.
Cutting them out of money from Superchats, by offering a 3rd party platform to do it instead, seems like it would fit.

It almost certainly is covered by their harassment policy. Throw in that they're stealing money from YouTube on top of that and they might take interest, especially if multiple people complain. Then throwing in a legal threat about right of publicity could also work. I mean there's an obvious parody defense, but I'm not sure it's good considering the totality of the reason of using the images is specifically to make money off them every time they're used.

Let's be honest, if YouTube bans Nick for using it, it'll be because they are being denied a cut. Though they might cite harassment as the "public facing" reason.
And obviously, nobody who isn't the direct target of this bullshit should bother. If anyone whose image is being exploited did, though, I wouldn't think they were a little bitch for doing it. Nobody wants pedophile drool all over their image.
 
DSP has been circumventing their cut for years getting direct cash through PayPal instead of superchats. Nothing is going to happen.
Melton has a large network of channels using it, not just himself. He’s offering a service where he takes a cut of multiple people circumventing YouTube’s proprietary Super Chat system. Way different than DSP.
 
I have said this over and over and over again you CANNOT use the likeness or voices of people without permission and even with permission usually they will ask for some sort of royalty etc... When you factor in that Fatrick is using super tips to embarass these same people there are all sorts of legal implications . He has got to be the dumbest fattest idiot of all time to even expose himself to all this . I think Uncivil or whetever recently gave him a cease and desist order.
