In my worthless opinion, you could easily argue that it was negligent of Destiny to share these videos to Discord, a platform he knows doesn't have access controls on uploaded files. His google drive (and recorder lol) files also didn't have any permissions set on them, so technically these are publicly accessible.

I'm pretty sure there hasn't been any update from Stasia or Chaeiry right? I have a feeling the police won't be that concerned about pursuing these cases, but again I know nothing about how any of this works. I also doubt either of them would want to try crowdfunding legal fees for a civil case, given how Pxie's fundraiser is going. Would be good to get some kind of update on how they're doing.

The law determines things in degrees. This is why there's first degree murder and manslaughter. Both are murder, both carry different penalties because the law recognizes the spectrum of experiences.

The law doesn't consider it "ok" to spread images without malice and that's why Pxie can also claim her privacy was violated. The legal code has been slow to catch up to all of the legal pitfalls that being a person on the internet represents and that's not just regarding sexual images. I think your non-lawyer legal reasoning has been sound. As per your other posts, we can guarantee with some certainty that he sent Pxie's video after October 1 2022.

I don't think it would be hard to argue that he transferred and made the images accessible because he published them to a public site with a public link (which is not the default setting as was explained by @Lord of the Pajeets ). I would also argue that just the act of sending them to women was making them accessible to "anyone." Solo, if different than Rose, accessed Rose's account and therefore accessed the images. Destiny has no way to know if the people he sends these to have their devices locked and that no one else uses their devices. That might be too broad of a definition of "make accessible" I admit. Still, the accessibility of those videos and images didn't change until Destiny deleted them. I'm kind of falling down rabbit holes but if he updated the files/descriptors and then re-saved them could the new version be considered a new instance of publishing? It's interesting to think about but I would hate for a case of mine to hinge on these questions.
