JUST IN: Judge Merchan Considers Throwing Out Trump Convictions

New York Judge Juan Merchan has admitted he is giving serious consideration to dismissing the Trump case under his purview, citing both the president-elect’s decisive victory and the Supreme Court’s immunity ruling earlier this year.
Trump was originally set to be sentenced in July, one month after being found guilty on 34 felony counts of falsifying business records to obscure a payment to adult film star Stormy Daniels. The charges, resurrected by Manhattan District Attorney Alvin Bragg, and subsequent conviction carried the possibility of prison time. At the request of President Trump’s lawyers and as a result of the election, Judge Merchan begrudgingly agreed to delay the sentencing hearing until November 26th, one which is now all but certain to never see the light of day according to CNN’s chief legal affairs correspondent Paula Reid.

“I’m told that his legal team is going to try to make sure that sentencing never happens,” she told anchor Jake Tapper, the New York Post reported. “As we know, their usual strategy is always to just try to get things delayed. But here they’re going to argue to the judge that the sentencing should never happen because now that Trump is president-elect, they will say that he is entitled to the same constitutional protections as a sitting president and should be protected from state actors and in this case, state prosecutors and the judge overseeing that case.”
“He’s giving himself a deadline of November 12th to decide if the conviction against Trump should be tossed based on the Supreme Court’s recent ruling on immunity. If he tosses the conviction, there’ll be no sentencing. But if that sentencing continues to go forward, this is the argument that the Trump team is going to make.”
Trump, 78, was already appealing the conviction in light of the Supreme Court’s decision on presidential immunity. Other legal experts told the Post that all hopes of seeing the president-elect in a striped jumpsuit are now dead and dashed. “Merchan doesn’t have the stomach to imprison a former president or president-elect,” former prosecutor Neama Rahmani said. “Now that Trump has won, his criminal problems go away.”
In August, a federal judge dismissed the classified documents case against Trump brought by Biden Justice Department special counsel Jack Smith, citing the immunity ruling. President-elect Trump is expected to move swiftly to dismiss Smith’s second case alleging election interference resulting from the January 6th, 2021 riots at the Capitol, but the federal prosecutor has more immediate concerns. Shortly before the election, the Republican has promised to fire Smith “within two seconds” of taking office, the BBC previously reported, as he flexes his grip over the Justice Department and installs a trustworthy U.S. attorney general. He has long called the criminal and civil cases against him as part of a “political witch hunt” intended to kill his campaign.
 
Something tells me that the fact that this Judge didn't recuse himself from this political hitjob from day 1 means the DNC has serious dirt on him. Play stupid games, win stupid prizes.
Wouldn't be surprised if he has some dark secrets but that wouldn't be needed. He's a true believer in the cause. He's got a history with other Trump related persecutions. He thought he had all the power and backing and suddenly found out that he didn't.

One of his big first term failings (along with shockingly bad appointments) was taking far too long to realise that he couldn't make deals with the DC snakes that wouldn't be reneged upon the moment the wind changed. When you have them by the balls their hearts and minds will follow is regrettably good advice. He really needs to fuck them over hard with a gutted and restaffed DoJ carrying out the civil rights investigation of all time targeting, amongst others, the prosecutors and judges involved and absolutely hammer them. If he lets them slither away it'll happen again. And again and again.
 
The sad thing is a "Truth and Reconcilliation" committee needs to be set up. Ideally the new Congress that is coming in will handle it too give Trump a stage of separation. But the Political prosecutions of the last 4 years need to be looked into. Alot of the lawyers, judges and law enforcement officials involved in these things need to be raked over the coals. They don't necessarily have to go to jail, but there needs to be an accounting of what happened.

Also Trump has some real ride or die people in his entourage now. Many of them DC literate. Tulsi Gabbard, JD Vance, Ron Paul to name a few. And unlike the first term snakes, these are people who hitched their wagons to Trump when he was on the out. Very big difference to people like fucking Bolton from the first term. I doubt the mistakes of the past will be repeated this time and quite a few people in DC are in big fucking trouble. When you shoot at the King, don't miss.

If Judge Merchan is feeling petty he could just stay the sentencing while Trump is President I suppose. But that will just invite Trump's Justice Department to go after him. He's going to have to eat shit either way.
How does this even work, really? I thought a dismissal of felony charges could only happen before an adjudication of guilt/"conviction". Since Trump's already been convicted, can a formal ruling of guilt/conviction be dismissed too? Or would the judge move to just expunge his record (which, from what I understand, isn't enough to completely destroy court records) or just give him the Ralphamale ruling of "Suspended Sentence"?

The upcoming constitutional crisis is gonna be pretty Kino to watch regardless. A convicted felon- someone who is legally banned from owning a gun, voting, and even renting an airB&B among countless other life-ruining things is now appointed to the highest political office in the land and commander and chief of the planet's most well-funded military.

Call me optimistic but maybe there will be a re-evaluation of what should constitute a felony and how much such a conviction can hamstring your life- why should someone like Bryan David Range, who forgets to include income from a side hustle on an application for food stamps be banned from owning a firearm for life? Or renting an AirB&B 30 years after the fact?

I'm not sure and I am not a lawyer, of course, but I don't think he can. I think that would open up the case to being dismissed on technical grounds

What I think he could do is just sentence him and give him no time. That way they'd still have their 'convicted felon' talking point without the logistics and headache of actually sending him to prison
 
He didn't run again just to avoid paying penalties and serving maybe a day in jail, did he? That would be cowardly.
 
Guys, let's be fair - you call him a coward, but what would you do in his place? Convict the president-elect of what would be severe charges to any other civilian in the country and risk a civil war, or go 'oopsy-daisy, our bad'.

I wouldn't have entertained this kangaroo court case in the first place. He made his bed, now lie in it.

IANAL, but a Judge has the authority to set aside a jury verdict of guilty, and if he hasnt been sentenced yet, that might still be on the table.

Judge Merchan is in a real fix here. Either choice is going to look bad and lead to issues at the appeal stage.

I'm not familiar with New York law in specific, but under common law the standard for setting aside the jury verdict is based on a"no reasonable jury with the law and facts presented could have found them guilty" standard which is almost never used because cases that meet that kind of high standard get felted well before deliberation. So the question becomes why the fuck would the judge have allowed it to get to a verdict in the first place - and Merchan would have to explain his reasoning for all the very slanted rulings he made. (Like his jury instructions that ignored the Supreme Court's instruction and basically command the jury find Trump guilty.) If he doesn't walk a very fine line and turn his tongue silver, he could actually end up facing consequences beyond just the bad press. This is not the end, though, because BOTH sides can appeal this decision, and would be motivated to do so - Bragg would like to keep his conviction, and Trump would like to show the whole thing was unlawful. More on that below.

Option two, he tries to sentence Trump. If he gives Trump no time, then it again confirms this was a political hit job and fuels future purges, while probably setting Merchan up to get whacked by some insane Antifa loon. If he tries to sentence Trump to jail, that unleashes a shitstorm that will keep Trump from being incarcerated - at the very least pending appeal, because:
1. Basic Procedure is to grant a stay when the defendant is likely to succeed at appeal and also
2. To move for a suspension of his sentence or outright quash as being in prison would interfere with the Federal office to which he has ascended. Due to the hierarchical structure of the government, the Federal level interests trumps State authority, and in this case a State's interest in keeping the now President locked up for paperwork crimes cannot possibly outweigh the national, Federal interest in having a President that can freely travel and execute the duties of the office to which they have been elected by the nation. This is the basic underlying logic behind such ideas as 'you can't indict a sitting president' you might have heard before.

Which brings us to the shitshow that will be the appeal to the New York Court, which will be a brutal filing that is going to tear the trial judge apart for massive amounts of reversible error. (Not just on immunity, there are a lot of other issues but immunity is the biggest one since the SC made a ruling about it.) Its going to bring an incredible amount of scrutiny down on the judge, and put the appeals court in a real Morton's Fork.
1. They dismiss the case as being improperly brought due to immunity issues, which is going to make them and Merchan look like fucking morons for not staying proceedings until the Supreme Court gave guidance. The Appeals Court even had the chance to intervene, and declined, so its egg on their face as well.
2. They send it back to be retried and in the course make the trial judge look like a total dipshit asshole as well as themselves since they denied all interlocutory appeals. Trying to actually move this case forward under the Supreme Court's guidance would be practically impossible, but if they order it be done its going to be another shitshow that will generate tons of political capital....for Trump.
3. Or they rubber stamp the entire affair and send to the Supreme Court, who will be extremely pissed off that they have to waste their time dealing with the bullshit caused by multiple lower judges ignoring the SC's opinion.

There may be a way, theoretically, to thread the needle and somehow charge a President for a set of criminal actions that started before his Presidency and continued into it. (Hard to say, because the issue is so legally convoluted because the Supremes were trying to deal with the sheer idiot levels involved.) I use the word theoretically with optimism, because even imagining the most brilliant legal mind presented with the clearest set of legal facts, would likely decide to simply not pursue any post-election charges just to avoid the issue as cleanly as possible. Why walk blindfolded into a yard full of rakes when you can just....not do that?

Instead of doing that, Bragg decided that he was going to charge for all the checks cut while Trump was in office. A risky move, but potentially salvageable if he just refused to touch anything close to the White House or the actual Presidency. The only problem is that at every stage he used White House material to make the case move forward. He brought official White House communications and depositions from staff to the Grand Jury just to get the indictments. At trial he called as witnesses more White House personnel to grill them about conversations in the White House during the Trump Presidential term. All kinds of testimony, documents, and other evidence that is absolutely verboten (by the Supreme's Opinion) is woven into the fabric of this entire case from start to present.

On top of that, the judge in the case was so eager to railroad Trump that he also ignored and actively downplayed the potential issues. At every step of the way, Trump's legal team was filing their objections and making the very reasonable request to delay proceedings until they had guidance from the Supreme Court. Not only did the judge deny these requests, he went so far as to scold the lawyers for making the objections - as if they were frivolous. The judge could have just put everything on hold until a framework was defined, but he barreled on through regardless and now is in a real shitty situation.
