If the feds wanted to they could legally nab anyone at any time.
The US Code is about 30 times longer than the Bible and is subject to constant revisions. There's no one with perfect knowledge of it.
Even if by some miraculous accident you happened to be in compliance with federal law, a sufficiently motivated adversary would be able to find plenty of apparent violations to charge you with.

So, yeah, they could, but it's practically irrelevant. No one is going after him.
