Feminist Arrested At Bar After Confronting Male In Women’s Washroom

A woman who was arrested after confronting a man using the women’s restrooms in a bar in Cardiff, Wales has come forward to speak with Reduxx about her experience.

Kate, whose name has been changed at her request to protect her anonymity, had been at attendance during the day at FiLiA 2022, an annual feminist conference held to address issues related to women’s sex-based rights. In the evening after the conference, Kate visited Heidi’s Bier Bar on Mill Lane with her friend, Dr EM, a well-known feminist writer and advocate for disabled women. A few other women from the conference had also joined them.

Kate told Reduxx that, after an evening of drinking with the women, she went to the washroom and noticed what she described as a man who looked like a “drag queen” standing in queue for the women’s toilets.

Immediately, Kate confronted the trans-identified male and asked him to leave the women’s restroom.

“I said, ‘you’re a man, you shouldn’t be in here,'” Kate explained, going on to describe that the man and some female patrons began shouting abuse at her. “When I was down there, there was absolutely no one supporting me.”

Kate says bar staff were then alerted, and, while she was still in the restroom, approached her and demanded she leave.

Kate provided phone camera footage for Reduxx to review of the initial interaction she had with bar staff. In the video, a female staff member with yellow-and-pink hair accuses Kate of having threatened violence against the trans-identified male, an allegation she adamantly denies.

“The man was a lot larger than me, so I don’t know why I would do that,” Kate said, “I just said ‘a man shouldn’t be in the women’s toilets.’ I wouldn’t threaten him.”

In the video, the pink-haired staff member is joined by a male staff member who also enters the women’s restroom where the interaction is taking place, something Kate immediately objects to.

At one point, the female staff member begins berating Kate about “misgendering” the trans-identified male after Kate continues to insist a man should not have been permitted to use the women’s restroom.

While Kate is reluctant to release the footage to the public due to the possibility of her being identified, Reduxx has transcribed a portion of the conversation she had with the female bar staff member here:

Kate: You came in and asked me to leave the venue because a man was in the women’s toilets.

Bar Staff: Oh? You mean the transgender woman?

Kate: A man.

Bar Staff: A transgender woman.

Kate: A man was in the toilets.

Bar Staff: It was a transgender woman.

Kate: A man. You know it’s a man!

Bar Staff: They are a transgender woman. You need to respect their pronouns and the fact that they have decided to alter their gender. You have tried to attack a transgender woman, that is a hate crime. You have just recorded yourself admitting to a hate crime.

The interaction continued, with bar staff first insisting Kate had threatened to physically harm the trans-identified male, before changing their claim and asserting she had already “tried to throw a punch.” Kate immediately objects to the suggestion she had been violent.

“I haven’t thrown a punch! Why would I throw a punch!” She is heard saying. The pink-haired staff member begins telling Kate to stop recording her, a request Kate refuses.

Kate: I will leave the venue, but I will record you. I am telling you right now that I have lived in Cardiff for 40 years, and I have never experienced people like you harassing me in women’s toilets.

Bar Staff: So you have harassed a transgender woman?

Kate: No, it was a man.

Bar Staff: It was a transgender woman.

Kate: It was a man. A man in the women’s toilets and that makes me really uncomfortable. I am a sexual assault survivor and–

Bar Staff: So am I.

Kate: -I do not consent to men being in the women’s toilets.

Bar Staff: So, there wasn’t a male in the toilet, it was a transgender woman.

Speaking to Reduxx after reviewing the footage, Kate expressed bewilderment at the staff’s behavior.

While the interaction had occurred after Kate had consumed alcohol, there was no instance in the footage Reduxx reviewed during which Kate was abusive, violent, or otherwise aggressive in any way. She simply continued to insist a male should not have been allowed in the women’s restroom.

Kate recorded herself following bar staff out of the venue. When exiting the building, both the male and female bar staff began informing patrons sitting on the patio that Kate had been “homophobic” and “transphobic.”

Police arrived shortly after, at approximately 2 a.m. Upon arriving, they interviewed the trans-identified male and his friends, who insisted Kate had threatened them and that she was on cocaine.

“I am a 54 year old woman with two adult children. It’s Sunday night. I was not on cocaine. It’s so ludicrous,” Kate said. “They could have tested me, or given me a drug test — they didn’t. They searched me and took all of my belongings, I had no drugs. I only had a bar on soap in my pocket because I had been gifted soap.”

Kate says police began to interview bar staff, as well as the trans-identified male and his friends, at which point they decided to arrest her. She was placed in handcuffs, which she said were so large for her wrists that they were almost falling off of her.

Police were set to place Kate in a caged van, but she repeatedly insisted she was claustrophobic and did not want to be locked in such a small space. Conceding, she was placed in the back of the van. Dr. Em, Kate’s friend, came with her as an accompaniment.

“She was staying with me. I kept saying to them, ‘she’s staying with me, she’s got a brain injury. This is going to be really traumatic for her. Whatever you do you need to make sure she’s okay,'” Kate said, noting that she was still unaware of why, exactly she had been arrested.

After multiple hours, Kate was asked if she wanted to apologize to the trans-identified male, something police insisted would allow her to leave without incident.

“They said, ‘if you just apologize, then we can just leave all of this here and you can go home.’ I told them I was not going to apologize because I had not done anything wrong.”

Police reportedly consulted the trans-identified male who had been in the women’s restroom, and he declined to pursue any further investigation into the matter. Kate was told she was then “de-arrested” and was taken home.

Kate was not given any documentation related to her temporary detention, nor was she provided a reference number, charges, or anything else related to the situation.

The day of October 24, Kate says she visited the police station in search of answers. She demanded the name of the individual who had reported her to police, as she wanted to legally pursue him falsifying information about her in order to have her arrested. The police later said the reason for her arrest was on suspicion of a public order offense but that she was later de-arrested following the input of the alleged victim.

She was told she would get a call-back from the night shift with additional details, but did not hear anything further from South Wales Police.

Today, the arresting officer gave a statement to local media calling Kate and her friends “transphobic” for a vague article that was written without Kate’s input.

South Wales Inspector Grady stated: “At around 2 a.m. on Monday morning, South Wales Police received a report from a bar on Mill Lane in Cardiff city centre that a number of females were refusing to leave the premises after making transphobic comments and threats to a member of the public inside. The group were removed from the premises by door staff and a 54-year-old woman was arrested for a public order offence. She was de-arrested, as the victim did not want any further police action, and given suitable words of advice.”

Reduxx reached out to South Wales Police for comment, but has not received a response.

In the aftermath, Kate says she has been left “traumatized” by the situation, but does not want her experience to deter other women from speaking up.

“I feel really strongly that it is on all of us. We, women, need to say ‘no’ to men coming into our spaces. We need to say ‘no’ to children being given hormones. We need to say ‘no’ to all of it,” Kate says.

“If not you – who, if not now – when… men now think it’s okay to go in to women’s toilets, we have to speak up. We have got to make it uncomfortable for them.”

Kate is not the first woman in the United Kingdom to face legal consequences for speaking up in defense of women’s spaces or standing up for women’s rights.

In January of this year, a disabled woman in South Wales had her home searched and was subjected to police detention after being reported for committing a “transphobic hate crime” for putting up stickers raising awareness about domestic violence.

Earlier this month, Caroline Farrow, a mother of five who has been outspoken against gender ideology, had her house forced into by Surrey Police after her social media activity was reported as criminal. Farrow had previously been investigated by police in 2019 for misgendering a trans-identified male on Twitter in 2019.

There have been few elections as critical to transgender Americans as this year’s midterms. Over the past year, 238 anti-trans bills have reportedly been introduced in dozens of state legislatures. Trans people and allies have undertaken vast efforts to beat back the onslaught of bigoted bills that have dotted the landscape of late. The most straightforward way to combat such acts, of course, is to vote for elected representatives who can best protect our basic human rights.

Hundreds of thousands of trans people could find themselves disenfranchised at the ballot box this year thanks to the strict voter ID laws.

Trans issues have become an obsession in conservative politics since marriage equality became the law of the land. And now trans people seeking to exercise the right as participants in our democratic system by casting ballots on Election Day are being squeezed into an impossible position: demonized by bills that threaten our existence, while enduring violent propaganda that spreads false information to the same effect and being denied the single action that could best protect ourselves.

Add to that a Republican effort to intimidate voters, with armed right-wing groups patrolling early voting drop boxes in some states, and a large effort to recruit so-called poll watchers who want to interfere with the democratic process, and many trans people, who face a rising threat of transphobic violence, may feel too intimidated to even try to exercise their right to vote.

According to an NBC News report, more than 200,000 trans people in the U.S. could face voter restrictions related to voter ID laws. The reason is fairly simple to understand: Trans people often live in identities that do not match up with their legal IDs.

In many states, changing the gender marker on your legal identification is an onerous and often expensive process. Many states require trans people to have costly surgery or have doctors sign off on medical transitions. Some states, like Idaho, have fought back against the ability of trans people to change their legal gender markers at all.

I first socially transitioned in the fall of 2016. I came out at work that October, in the midst of the 2016 presidential election between Hillary Clinton and Donald Trump. On Election Day, I made my way over to the local polling place in styled, long hair and a layered fall outfit straight out of a Christian girl autumn Instagram post. But my ID was still associated with my previous identity, featuring a photo that was no longer recognizable.

Thankfully, my state, Maine, didn’t require me to present an ID to vote, so everything went fairly seamlessly. But for countless trans voters living in voter ID states, voting can turn into a nightmare of awkward and invasive explanations, or even outright hostility.

In 2018, a Vermont trans woman was initially denied the right to vote in the governor’s race because a poll worker refused to accept the gender marker on her ID. According to an Into report, the poll worker accused her of using a fake ID. Similar incidents of trans people’s being denied or restricted in their right to vote thanks to identification issues have popped up in several states.

If that is happening in liberal Vermont, it’s likely to be even worse in the ruby red states where lawmakers have openly declared war on trans people.

UK: Transgender Pedophile Granted Access to Domestic Violence Shelter for Women and Children

A trans-identified pedophile in Scotland used an alias to gain entry into a domestic violence shelter housing vulnerable women and children, where he was allowed to stay for 71 days before being removed. Katie Dolatowski, 22, is a registered sex offender for crimes involving young girls, yet was permitted to reside at the Leeds Women’s Aid Refuge.

Dolatowski provided official documentation supporting a new identity, which he used to deceive staff at the women’s shelter. Dolatowski was accommodated in a section of the refuge which houses people who identify as transgender, but it had some shared resources and spaces with the main women’s area.

Dolatowski has a disturbing history of sex attacks on young girls in public facilities. In 2018, he was discovered secretly filming a 12-year-old girl in a women’s bathroom at an Asda supermarket in Fife, Scotland.

The child was using a restroom cubicle and in a state of partial undress when she spotted Dolatowski recording her by holding his phone over the stall. The girl cried out for help and ran away. The supermarket’s CCTV footage was used to identify Dolatowski, and upon further investigation, 12 seconds of film of the girl were found on his mobile phone and iPad.

The following month, Dolatowski targeted another young girl for sexual assault in the restroom of a Morrisons supermarket in Kircaldy, Fife. He grabbed a 10-year-old girl by the face and pushed her into a cubicle, ordering the child to remove her pants. During the assault, Dolatowski also threatened to murder the child’s mother in an attempt to frighten her into compliance. However, the young girl struck out in self-defense, landing some blows against Dolatowski, and was able to break free and run for her parents.

Despite his two attacks on children, Dolatowski was handed a three-year community order in lieu of a prison sentence. He was also banned from having contact with children, placed on the sex offenders registry, and ordered to complete community service.

Upon learning of Dolatowski’s disturbing history, management at Leeds Women’s Aid had him removed from the premises. Chief Executive Nik Peasgood told The Sun: “We are appalled that someone with such crimes could come to a women’s refuge using a different identity. We are aware a criminal using authenticated identification could access any housing provider’s services and we are not unique in being manipulated in this way.”

Farah Nazeer, also a chief executive at the shelter, added, “This situation is a priority for us, alongside supporting our federation of local domestic abuse services.”

A mother of three and a resident at the refuge told The Sun that the situation frightened her and made her fear for the safety of her children. “It’s horrific. As a victim of sexual abuse myself, the whole thing is triggering. I came here with my kids because I thought it was a safe place and to find out there was a pedophile living a few doors away for months is just horrendous.”

As previously reported by Reduxx, Dolatowski, who stands nearly 6’5, was ousted from a public housing estate on the night of October 19 after enraged neighbors became aware of his past crimes. A crowd gathered outside of the property, demanding his expulsion. A phone recording taken by a bystander shows a large number of police officers present, removing Dolatowski and unidentified others from the residence.

This is not the first instance of Dolatowski being granted access to a women’s shelter.

In February of 2019, the Courier revealed that Dolatowski, who was homeless at the time, had been housed in a hostel for female offenders on the basis of his self-declared gender identity. This was permitted despite the fact that Dolatowski did not have a Gender Recognition Certificate (GRC), a legal document that establishes a change to one’s name and birth sex on their identification.

One woman who was residing in the unit for homeless offenders told The Courier: “This is a women’s hostel and it’s all women who work here. I feel sick and can’t stop thinking about what he has done.”

An editorial decision was made in the news article to alter the woman’s wording by using the feminine pronoun “she” in place of “he.”

At the time, a spokeswoman for Women and Girls in Scotland noted that accomodating males in certain female-only spaces, such as prisons and crisis shelters, can be triggering for the vulnerable women residing there.

“Female offenders are very likely to have experienced male violence and/or abuse, and many suffer from conditions such as PTSD. As such, the presence of males in spaces where they are vulnerable could understandably be very distressing for these women, and for many the presence of a male sex offender will prove to be unbearable.”

She went on to denounce the lack of safeguarding measures, stating: “Katie Dolatowski has already taken advantage of access to female spaces to commit sexual assault. It is absolutely unacceptable that this person was being given the same opportunity again.”

Currently, violent male offenders incarcerated in Scotland can be placed in women’s prisons provided they are recognized as transgender.

In October, the Scottish Prison Service (SPS) confirmed that half of the current inmates who identify as transgender only began doing so following their convictions.

Pakistan Bans Oscar Contender ‘Joyland’ for its ‘Repugnant’ Material

The government of Pakistan has banned Saim Sadiq’s Oscar contender “Joyland” for containing “highly objectionable” material.
An order dated Nov. 11 from Pakistan’s Ministry of Information and Broadcasting says that the country’s censor board had granted a censor certificate to the film on Aug. 17. But it has since reversed the decision.
“Written complaints were received that the film contains highly objectionable material which do not conform with the social values and moral standards of our society and is clearly repugnant to the norms of ‘decency and morality’ as laid down in Section 9 of the Motion Picture Ordinance, 1979,” the order states. “Now, therefore, in exercise of the powers conferred by Section 9(2) (a) of the said Ordinance and after conducting a comprehensive inquiry, the Federal Government declares the feature film titled ‘Joyland’ as an uncertified film for the whole of Pakistan in the cinemas which fall under the jurisdiction of CBFC with immediate effect.”

“Joyland” was due to release in Pakistan on Nov. 18. Variety reached out to Sadiq and the film’s producers who are offering no comment at this time. An official statement is expected imminently.

As the Ranas yearn for the birth of a baby boy, Haider secretly joins an erotic dance theater and finds himself falling for a fiercely ambitious trans starlet. Their love story illuminates the secrets and desires of the entire Rana family.
The film debuted at the Un Certain Regard strand at Cannes earlier this year, where it won the jury prize. Nobel laureate Malala Yousafzai has joined the project as an executive producer. It is Pakistan’s entry in the Oscars’ international feature category.
On Friday, it won the Asia Pacific Screen Awards’ young cinema award, given in partnership with critics’ association NETPAC and the Griffith Film School.
After hearing of the ban, APSA said in a written statement: “ ‘Joyland’ represents a significant new cinematic talent in Saim Sadiq from Pakistan, who has crafted a moving and entertaining drama about family in his debut feature film. The Young Cinema Award Jury commends Saim Sadiq for his brave and joyous celebration of community diversity and the universality of love.”
Sadiq recently spoke to Variety about the Oscar candidacy and his nerves about bringing the film to Pakistani audiences.

Bit torn on this one. The Pakis banned it for degeneracy (ok, whatever) but I doubt the Academy would have even considered it if it wasn't run through with troon themes.

NZ: Trans-Identified Male Sent to Women’s Prison After Stabbing Spree

A trans-identified male in New Zealand has been handed a 9-year prison term for a stabbing spree at an Indian restaurant earlier this year which left three people, including his ex-girlfriend, severely injured.

Matthew Richard Nelson, a male who identifies as a woman named Pandora Electra, appeared for sentencing in the Hamilton District Court today. He had pleaded guilty to three charges of wounding with intent to cause grievous bodily harm, as well as charges of breach of a protection order, intentional damage, and resisting police.

Nelson, 31, had stood accused of stabbing three victims at the Sahara India Restaurant in Cambridge on May 4 of this year. One of the victims, a female, was Nelson’s former partner. A police summary of the incident presented to Court during a hearing earlier this year said Nelson had acted in a “quick and aggressive manner.”

According to police reports, Nelson had entered through the rear door of the restaurant and stabbed a male staff member in the shoulder as he worked in the kitchen.

Nelson quickly targeted another worker, a female who was later revealed to be Nelson’s ex-girlfriend. He slashed her in the face and stabbed her in the upper back, causing her to suffer a punctured lung. Despite her horrific injuries, the woman managed to run out of the building and flee for help at a nearby gas station.

A customer who attempted to intervene in Nelson’s stabbing spree was similarly attacked, losing over a liter of blood after he sustained an injury to his abdomen.

Nelson then grabbed a chair, which he used to smash the restaurant’s front windows, and fled.

While being forensically swabbed in police custody by a doctor, Nelson is alleged to have remarked: “this is a bit excessive for only stabbing three people.”

Today, Nelson was sentenced to 9 years and three months in prison — and must serve at least 60% of the sentence before he can be considered for parole. According to Stuff.nz, the presiding judge respected Nelson’s identity as “Pandora Electra” — a new name he has introduced since previously identifying as “Emma.”

A motive had never been clearly determined for Nelson’s spree, and during the proceedings, the court sealed matters pertaining to Nelson’s situation which may have shed clarity on the reasons for the attack.

Nelson is currently being housed at Auckland Women’s Prison. A pre-sentence report submitted to the court had found Nelson to be a high risk of violent harm to others.

In December of 2021, the New Zealand Parliament unanimously passed a bill enabling total gender self-identification on legal documents. The Births, Deaths, Marriages, and Relationships Registration Bill dropped the requirements for any medical or court prerequisites prior to applying for a legal gender change.

Prison placement is largely based off of legal sex, with initial accommodations always matching the sex on the offender’s birth certificate. If an individual does not have a legal gender change but self-declares a transgender identity, they may still be eligible for transfer. The only known restriction is that offenders convicted of “serious” sexual crimes cannot be transferred to a prison housing inmates of the offender’s nominated sex.

The New Zealand DOC website advises prison officials to “consider the support the trans person needs and wants while in prison.” Corrections staff are required to discuss a support plan with trans-identifying inmates within three days of their reception. Men who claim a female identity may be provided with prosthetic breasts, brassieres, and feminine undergarments, and they may choose to request to be searched by female officers.

In April this year, a concerned citizen requested information regarding the number of trans-identifying prisoners currently being housed in women’s prisons. Dianne Landy filed a request asking for the figures, as well as the amount of individuals who have a medium to high risk security rating.

The DOC replied in an evasive manner, without providing the information and instead delayed their response indefinitely.

Cummins has an extensive history of horrific sexual offenses, the overwhelming majority of which were against children. His first conviction took place in September of 1997, when he was found guilty of indecent assault. For this, he was fined $3,000 and did not receive a prison sentence.

In December of 1999, Cummins was convicted on three counts of indecent dealing with a child under the age of 13 years. He was sentenced to 2 years imprisonment.

Once released, Cummins immediately began to sexually abuse a girl he was related to who was between the ages of 6 and 8 at the time of his abuses. In June 2002, he was found guilty on four counts related to crimes against that child. Cummins was sentenced to a total effective sentence of 8 years imprisonment.

Earlier that year, at the age of 36, Cummins had married a 17-year old girl. Forensic psychiatrist Dr. Gosia Wojnarowska, a mental health consultant to the Department of Justice, described this relationship as a substitution for “a female child that he never stopped fantasizing about” in a 2008 assessment of Cummins.

In June of 2009, the serial pedophile was convicted of one count of possessing child pornography and sentenced to 12 months imprisonment. Two years later, Cummins was detained awaiting trial for conspiring to engage in sexual intercourse outside Australia with a person under the age of 16 years.

But even being in custody did not stop the disturbed predator from planning out his abuse against children.

Between July 2005 and September 2008, while incarcerated in Perth’s maximum-security Casuarina Prison for filming the abuse of his youngest victim, Cummins, along with two other men, devised a scheme to establish a child sex trafficking ring in Thailand upon their release.

The convicts intended to set up a doll-making business called “Little Angels” as a cover. Former teacher Mark Pendleton, 53, and Kenneth Bishop, 74, conspired with Cummins to employ low-income women from rural areas in order to gain access to their children.

In 2011, Cummins testified in the Perth’s Magistrate Court that he had first befriended Pendleton in a sex offender treatment program in Perth’s maximum-security Casuarina Prison. They began plotting to abuse vulnerable children after they were both relocated to Karnet Prison Farm.

“Mark told me families in Thailand were available for a price. If they were willing to send their children into minefields to look for shrapnel, they would be willing to sell their children for sex,” Cummins told the court.

After he was released on parole in 2008, Cummins became the “pipeline” for carrying out the plan, and began researching properties for sale and information about false passports while contacting Thai mothers whose children were being considered for potential abuse. Cummins also sent financial contributions to the impoverished women to build up their trust.

“The idea behind it was to assist them and become valuable to them,” Cummins told the court. “So they would allow me to do anything I wanted… Including sexual activity with the children.”

In phone recordings played during court proceedings, Cummins could be heard saying that the women he was most interested in employing would come from villages and ideally should be “more simple people.”

The recorded conversations between the men were “laden with jokes and sexual innuendo”, and referenced former pop star and pedophile Gary Glitter, according to news reports. Cummins told Pendleton that women had sent him photographs of their “lovely families,” which he explained to the court prosecutor was a reference to their children.

Cummins admitted he and Pendleton considered supervising an orphanage in order to “effectively convert it into a child brothel.” He stated, “From our point of view, we had discussed setting up an orphanage and having access to the children there for sexual purposes.”

In exchange for pleading guilty, testifying in court, and confessing to the plan, Cummins was handed a reduced sentence of two years and seven months. Despite the fact that authorities had uncovered their plot by tapping their phone lines, Supreme Court Justice John McKechnie ordered Cummins to be freed from jail on a recognizance release order, as he had spent 18 months in custody pending trial.

He was released the day after the trial ended in September 2012, despite the court having been told that Cummins was estimated to have committed 1,000 sex crimes against children during the course of his serial abuses.

In 2014, Cummins, then 49, was spared yet another jail sentence for a historical sexual offense he admitted to committing against a 12-year-old girl. The sentencing decision was made on the basis that his use of “anti-libidinal drugs” had deprived him of his sex drive.

Western Australia District Court Judge Michael John Bowden sentenced Cummins to 12 months in jail, suspended for 18 months, on the provision that he comply with a supervision order.

“It really is the fact that the chemical medication seems to have deprived you of any sex drive that leads me to deal with this case in the manner in which I am going to deal with it,” he said.

Judge Bowden added, “The offense is so serious that imprisonment is the only appropriate disposition but it does seem to me that I cannot say that a suspended sentence in the circumstances would be wholly inappropriate.”

In 2018, general practitioner Dr. Wynn Owen recommended that Cummins’ chemical castration treatment be halted out of concern over its side effects. Cummins had been taking cyproterone on an intermittent basis since 2004, and on a regular basis since 2012. However, medical reports revealed that once he stopped taking the antiandrogen, he experienced a “floodgate return of sexual thoughts.” The same report detailed how he feared he “would have progressed to snatching a child.”

In 2019, Cummins was diagnosed with “gender dysphoria” and began to self-identify as a woman. Court records note that he had “formed a platonic relationship with another transgender female” around this time. Additionally, Cummins’ “interest was directed to gay pornography,” which “preceded the transitioning from male to female.”

The most recent ruling was in response to an application for an extension to Cummins’ supervision order, which was filed by legal representatives for the State. Concerns were raised that he remained a “high-risk offender” and should be monitored for safeguarding purposes.

Dr. Wojnarowska told the court that pedophilia is regarded as a lifelong condition, and a 2021 assessment was presented as evidence in court. “In my opinion, if [he] were to be taken off the order, [his] risk of sexual reoffending may escalate,” Wojnarowska stated.

However, she pointed out that hormone treatments carry considerable health risks and are not recommended for long-term use due to their effect on bone density and liver function. She therefore recommended surgery.

This opinion was supported by forensic psychologist Julie Hasson. Ms. Hasson recommended an orchiectomy as a means of “living as a woman and reducing [his] libido to protect against any concerns of future sexual offending in the event that [he] did not pursue gender reassignment surgery,” according to court records.

Justice Michael Corboy ruled that a new four-year supervision order be imposed with conditions including “testosterone suppressing treatment.” He noted that the diagnosis of gender dysphoria was “obviously a very significant event,” with his “transition” being “central to the issues” in his case. The judge added that the court should keep Cummins’ gender dysphoria diagnosis and transition “in mind” while considering his risk of re-offending.

Cummins was referred to with feminine pronouns throughout court records and proceedings. Media coverage similarly utilized ‘she/her’ pronouns for Cummins, as well as did not identify him directly or give an indication of the name he is currently utilizing.

Cummins’ case recalls that of a notorious American serial pedophile who was similarly released into the community after the court was told his transition meant he would be “less likely” to offend.

Joseph Matthew Smith, who also goes by the name Josie Maria Dunham or Josie Smith, made international headlines in 2020 after being released from prison after beginning a gender transition. Smith had been convicted of sexually assaulting an 11-year-old resident at Midwest Christian Services (MCS), a treatment facility for juveniles.

Due to his lengthy history of sex crimes, a pre-sentence psychological report was carried out. Smith told a state forensic psychologist he had molested as many as 15 children under the age of 13, the youngest being a 1-year-old baby. Due to his extremely high risk of re-offending, Smith was handed an indefinite prison sentence.

But after being diagnosed with gender dysphoria and beginning a hormone regimen, Smith was released, with officials claiming he was now at a lower risk of re-offending due to an altered testosterone level, and that he “no longer had the sex drive of a man.”

Smith was paroled in January of 2020 but by October of 2021, he had already violated the terms of his strict conditions by using an unauthorized electronic device and seeking out sex. Despite the violation, Smith was not remanded to custody, and was instead allowed to continue to live in the community.

Since his release, he violated the conditions of his parole twice by attempting to access child sexual abuse materials. Smith is currently incarcerated at the Newton Correctional Facility, which is a men’s institution with a special program for sex offenders in Jasper County.
