EXETER, N.H. (AP) — A New Hampshire student-athlete is suing his school district after he was suspended from a football game for allegedly expressing his view that there are “only two genders.”

The lawsuit, filed on Nov. 4, said that the suspension in September was in violation of the student’s constitutional right to free speech and the New Hampshire Bill of Rights because he expressed his religious beliefs, The Portsmouth Herald reported.

The plaintiff is also aiming to prohibit enforcing Exeter High School’s gender-nonconforming student’s policy because of what he says is its infringement on his First Amendment rights.

The policy says that students have the right to be addressed by a name and pronoun that relates to a student’s gender identity. It also reprimands students who intentionally and repeatedly refuse to respect another student’s gender identity.

According to the lawsuit, the suspended student had been involved in conversations surrounding Spanish language pronouns on the bus. A female student who overheard the conversation said there were more than two genders, to which the suspended student argued that there was not.

Soon after the bus incident, the lawsuit stated that the two students got into a text exchange about gender identity. Those texts were given to the administration which resulted in the one-day suspension.

But the lawsuit claims that EHS administrators did not have the right to suspend the student because his text messages, initiated by another student, were sent while off campus.

Exeter Superintendent David Ryan said he is aware of the lawsuit and the school is “in process of reviewing this complaint with legal counsel and will be able to share a statement once we have completed that review.”

NH is one of those fun states that absolutely hate big government and anything that shits all over their freedom's they go sue happy on people. It's one step away from organized anarchy.

I'm afraid he will lose, even if its a cut and dry 1A case to me. SC has been disgustingly open to the tranny-genda over the last few years (they view it as equivalent to gay rights for some bizarre reason) and it was related to student interactions.

The court decided on a case this year about a school punishing a student for language posted on social media. They said that since it wasn’t on school grounds, the student could not be punished. On top of their universal equivocation of “hate speech” being free speech, this case is on the student’s side, unless New Hampshire law has some radical diversions from federal law.
 
When I went to school I remember questions in Biology being very carefully worded to allow fundie kids to be tested on their knowledge of the theory of evolution without making them make statements about it's validity. I miss those days.

Kids should be tested on their knowledge of a subject, not on their opinions of it.

No offence but this kind of doomer mentality is the exact reason why these woke weirdos have managed to get this far.
If everyone sued when this stuff happens, woke shit would never become a thing, it would be a fringe belief system that 99% of people aren't aware of.
Always sue, every single time.
Personally, I'm just waiting for the day this kind of stuff happens to me so that I can get a nice settlement and retire.

Most people absolutely loathe the mere thought of being involved in a lawsuit on either side. Your nose wouldn't happen to be particularly long and semitic, would it?

Being in a lawsuit would be grating but the financial benefit of winning a case like this would be worth it, suffer for a few weeks/months so that you can chill out for years.

Also, I'm not a Jew, I do know a Jewish lawyer but I don't think I would need him.
This is a clear cut case so 2-3 weeks of solid preparation and I could defend myself, the law is there for everyone to learn if they want to.
 
Exeter is about 40 mins out of Boston when the traffic is good, so it‘s towards the northern edge of the Boston bedroom community area. I’m not surprised it happened there.

The whole NH coastal area is a really bizarre group of people - the intersection of people who want to work in Boston and Maine while living in NH, and the people who want to live & work in NH while being close enough to Maine and Mass to go there on weekends. It’s NIMBY’s, Libertarians, granolas and blue bloods all living together.
