You can shoot a gun at someone without desire to kill them while acknowledging that you could possibly kill them. Kyle knew that but had to take that risk to defend himself. Prosecution's argument here is gonna make me foam at the mouth.
 
The constant, and I really do mean CONSTANT, mischaracterization by the prosecutors is making this whole trial really confusing, especially rn. I honestly don't think I would be able to follow along if it weren't for Rekieta Law's commentators.
It's intentional. Their case is on the facts and on the law, utter trash. All this obfuscation is them trying to ram in another lesser charge to get themselves a win. And judge isn't buying it. It's very clear they think 1st degree is dead in the water, so they want a lesser charge so that the jury can go "well we couldn't find him guilty of 1st degree, but we can in 2nd degree/whatever other garbage they want".
 
Fucking hollowpoints-- Weren't they Full Metal Jacket rounds, or did I miss something when they were discussing the gun? I can't remember. Either way, FMJ rounds overpenetrate, and feasibly does less damage than hollowpoints. Hollowpoints basically shatter on impact and do a lot of damage to flesh, but can't do shit to armor or material.

Still, a .223 round is gonna "vaporize" anyone's muscle at close range like that.
Thats the pros trying to stick him with recklessly endangering the reporter who was behind pedobum. They are saying he should have used HP rounds to not endanger any bystanders. It's a retarded damned if you do damned if you don't though. If he had have been using HP they would argue that that is proof he just wanted to kill kill kill.
 
Okay so I didn’t know how they would include lessers. So they have to give a reason for acquittal on the greater charge and reason for conviction on the lesser
 
He used FMJ, as far as I can tell this is because FMJ is much cheaper, the rifle was intended for range shooting, and he just used what he had when he went to Kenosha, rather than going to Walmart and buying a new box of Hollows.

Arguably he maybe should have had hollows, but it scarcely matters.
Also at the time, ammo was in short supply. Even if he had wanted some 5.56 hollow points, he probably wouldn't have been able to find them. Ammo was scarce all around, but by the major cities it was even worse.
 
Fuck these slimy pieces of shit. They're obviously trying to make anything stick in any way possible regardless of letter or spirit of the law. This is not pursuing justice, it's pursuing a conviction.
Yeah that's pretty much every DA and state prosecutor. Turning justice into a win/lose, for profit game has been a disaster.
 
Fatty Arbuckle is just outright lying here, isnt he? He's constantly stating that Kyle said he "Didnt intend to kill anyone", while to my knowledge Kyle has merely stated that he "Didnt want to kill anyone", which are rather different things.
 
Are they really arguing utter disregard for human life because Kyle wasn't a perfect sharpshooter and missed and could have hit someone else while being attacked? Are they really demanding perfect accuracy in a high stress situation with only seconds to react? It's not like Kyle emptied his gun into a crowd.
That's where the precedent this could set gets terrifying. High accuracy and precision under duress is uncommon, and as we all agree, Kyle's accuracy in this incident was about as clean as it could be, with no notable collateral. The requirement to have John Wick levels of skill to defend yourself is dumb as hell.
