They just handed Venus a $10k signing bonus (and apparently not an "advance" that'll come out of her future earnings), there's no way their legal team will let this slide, I don't think. Margo feels she owns / created the character "Venus Angelic" because she gave birth to Venus, so anything she does is Margo's (to mags). However, if Margo had any legal claim to the brand, the Fullscreen contract would have been with Margo and not Venus.

Also, even if Venus can't contest the past DMCA claims, there's zero way Mags can have claims on anything V made in the last 2 months. Also, filing an initial DMCA claim will get the content taken down swiftly; but false claims used to harass someone are considered perjury under US law (and since both YouTube [google] and Fullscreen are US based, I believe they'd be under US legal jurisdiction - but please correct me if I'm mistaken!) Here's some legalese about false takedown claims.

I doubt Venus has the money to hire a lawyer to fight this, but here's hoping Fullscreen earn their shekels by fighting this battle for their client.

Sorry to double post, but someone on lolcow just brought up a frightening point: they said that when you counterclaim a DMCA notice, your name and address (from the response / counterclaim) is sent to the party which filed the takedown notice. If true, this means Margo was a very clever girl. The takedown notice rocks Venus's world again, just as she was beginning to get a little hope that Mags' visa was almost up; it fucks with Venus's income; it shifts the attention back on Margo; and if Venus responds, Margo will get her address.

I HOPE that the counterclaim would use her management /business address, which keeps Venus physically safer.

Venus had briefly posted something this morning about being sad, but that it the end of the sadness was near. Many people speculated that she was talking about Margo's visa being up soon, which V must've been counting on as an end to this stress. Hopefully they'll be able to do it soon, because unfortunately this is the sad truth of how Youtube operates when it comes to flagging of videos, including how painful it can be to do a counter claim through the regular channels. Basically, there is absolutely no repercussion for people who put up false claims. Zero. They would have to go after her for something else. They won't "protect" her channel as the DMCA is an automated system with the amount of videos the site has.

That's absolutely disgusting. So YouTubers have basically no protection/repercussions from people falsely claiming the content is theirs? Even though they're losing revenue whilst their channel is down? They can't legally pursue those lost earnings? I assume the complainant doesn't financially benefit from making a false claim though, because surely that would be fraud? In fact, all of it is fraud, get your shit together YouTube. Wow.

Back OT, I hope the process is quick for Venus as that income was her independence. It was the one little thing she had to support her new life with her new husband. I just can't fathom Margo sabotaging her daughter to such an extent.
