I'd agree it's a meeting of the minds between KUSK and Elliot.

They both hate free speech, they both hate conservatives and anyone not freakishly Left and both REALLY hate the Farms. And Elliot is rich and stupid so yah I can see KUSK massaging the relationship just so they can milk Elliot for profit while pursuing their sad little goals. Mostly I'd think it's that fat ugly cunt paralegal doing most of the massaging, as it's been a constant legal pest towards anyone it can harass with pointless lawsuits.

Personally I hope KUSK keeps milking Elliot for every cent he's got. No one deserves to be bilked by lawyers more then that dickless wonder.

If their logic is to use Elliot to go after the farms that's probably the worst possible person they could pick to go after the site considering Elliot's past and what he's hiding.

I still don't think we're out of the woods with Mercante. I think once that SmashJT lawsuit is over Alyssa is gonna pull something to try and go after the Farms, especially with Elliot wanting someone to pressure Josh to drop the lawsuit.

1. He won a case and then the defendant asked him to represent them in other matters which would mean he could no longer participate if his current client wanted to sue them again.
2. He offered a $25k advance to the same client without reminding them that they can have someone else look over the promissory note.

Im less optimistic due to the judge admitting Randazza. Thats a formality, and largely one based upon lawyer culture then anything truly worth litigating. Its akin to an Ambassador presenting credentials. Yes, in theory the credentials could be rejected. But they almost never are, and the presentation is largely ceremonial. With the caveat that you cant do the job until after the ceremony.

What is making me optimistic however was KUSK jumping the gun and going on a Subpoena spree against various John Does. Up until that point, it could be seen to an uninterested and uninformed party like this Judge almost certainly was that Hardin and Null were throwing a shit fit about nothing.

But now there is over half a dozen John Doe subpoenas doing precisely what Plaintiffs were rushing to the court house to stop with declaratory judgement. Which is why I find it so bizarre that Fong and his lawyers would involve so many parties immediately after getting sued. The subpoenas essentially make Lolcows point, where before it was just hypothetical conjecture about things that could happen

The impression I get of KUSK from their various appearances on the Farms is that they're true believers and not particularly competent, rather than cynically fleecing Fong Dong like others suggested.

I have not looked at other litigation for KUSK, but Remy Green, the lawyer primarily representing Alyssa Mercante (Cohen & Green PLLC), where KUSK is still also counsel on record and CC'ed in every email exchange and filing, is really making bank on the full left wing agenda litigation.

Just in federal court alone there are dozens of civil rights cases stemming from NYPD arresting protestors and clearing out protest camps during the "Pro Palestine aka ITerroristCock" riots in NYC where Remy is representing the rabid Terrorist supporters in civil claims against NYC and the NYPD.

So I see them as both "believers" and opportunistic leeches sucking the Soros and Gates money from the NGOs financing the lawfare against Law & Order.

If you go into a profession where you get paid the most for the morally questionable representations, this isn't really surprising.

My guess would be sunken cost fallacy.

Elliot Fong-Jones, in his crusade to delete his self-admitted rape accusation from the internet, has been paying KUSK for a long time. For years probably. We know he pays KUSK to monitor MATI streams, to scrape the Farms for any posts related Mr Elliot Fong-Jones, and to log and collate all that for use in their attempts to unmask and then punish anyone who would dare to associate with the Farms or Mr. Moon.

This is not cheap.

Elliot Fong-Jones, in his crusade to delete is his self-admitted rape accusation from the internet, has paid out a fairly hefty chunk of change to KUSK. My guess would be at the minimum 6 figures as KUSK's lowest rate is around $350/hr and only goes upward from there and I highly doubt KUSK is giving Elliot Fong-Jones the Hardin discount. But he's probably also only paying for the (troon? It's honeslty hard to tell if that legal pest is a woman or just a man pretending) paralegal's time as I doubt any KUSK lawyer would bother with such petty things so I used the lower end of the fee scale to estimate.

Like most narcissists Elliot Fong-Jones just assumed Mr Moon would wait patiently, like a good boy, until he was ready to "drop the hammer and silence Kiwi Farms once and for all" and then quietly go to jail after handing over the all user data, but alas this was not what happen and Mr. Moon launched his preemptive lawsuit. So now Elliot Fong-Jones has a chioce to make.

Chances are he will lose this case. It's a pretty straight forward fair use case after all, and once the judge rules said images are indeed covered under fair use law then that's that. No subpoena's for Elliot Fong-Jones. So my guess would be that he decided to gamble. Yes firing off 8 DMCA subpoena's at the same time pretty much confirms everything Mr. Moon is claiming about Mr Elliot Fong-Jones's intentions towards the DMCA and Kiwi Farms, but maybe those subpoenas would come across the desk of a friendly or lazy clerk who would just rubber stamp them or perhaps the subpoena's themselves would be enough to bring those dirty, evil, transphobic, nazi, Kiwi Farms users to the table so Elliot Fong-Jones could brow beat them into submission via legal arbitration.

It was a gamble, and not one I would have made if I was in Elliot Fong-Jones's place. But I thank the Lord God above that I am not. IMHO this was a mistake and it will not aid Elliot Fong-Jones in his attempts to get his self-admitted rape accusation scrubbed from the internet via the abuse of the DMCA system.

It absolutely was. People like to bang on about "OMG, its a court in New York", but it has to keep getting pointed this is the same courthouse that forced Akilah Hughes to pay Sir Carl of Applebees tens of thousands of dollars for her bullshit copyright action. The 2nd Circuit deals with as many copyright cases as the 9th circuit due to the presence of so many news media corporations and publishing houses in the city. They are not a circuit that will go off the reservation like the 10th circuit which maybe gets a copyright case once every blue moon because who the fuck argues copyright in Utah?

There are precedents at the district level made by this judges own colleagues on fair use, not to mention everything else done by the 2nd circuit panel itself. I have a feeling KUSK had it in their heads that they would be fighting this in the 4th circuit, which doesn't really deal with copyright, much like the 10th. Yeah, copyright cases crop up in the 4th, but its not really something they deal with on the regular.
