The horse has left the barn and is now 3 states away, "Sure you can seal those"
This may be judicial malicious compliance; I done seen it before. The horse has left the barn and is now 3 states away, "Sure you can seal those"
What the fuck?
Holy crap, a successful Motion To Undo The Thing That Was Just Done. After following so many pro se retards, never thought I'd see it work.It is now
How much of a risk is there of this decision setting a precedent that other countries will use in the future to coerce US courts into doing things, citing established case law in Cologix v. Path?
Case law from a state court in Arizona.... not much. How much of a risk is there of this decision setting a precedent that other countries will use in the future to coerce US courts into doing things, citing established case law in Cologix v. Path?
Path Network Inc v. Roosen, actually. This was converted into a general Path litigation thread January of the last year.case law in Cologix v. Path?
It's probably going to mostly be confined to Arizona for now. But get a few more state courts to issue similar decisions, and you can start presenting them as persuasive caselaw to the actually important courts (in the far reaching sense). How much of a risk is there of this decision setting a precedent
Maybe not this case but this issue is absolutely going to go to the supreme court. It's probably going to mostly be confined to Arizona for now. But get a few more state courts to issue similar decisions, and you can start presenting them as persuasive caselaw to the actually important courts (in the far reaching sense).
It feels more like an individual judge trying to make a generic "in the interests of justice" deal. Path didn't follow the rules cleanly, Gervais went through a court process to get the confidentiality protections he wanted, the judge goes "meh let him have it. It's an unusual circumstance, it doesn't prejudice either party, and it doesn't really matter to this case".Im really wondering if this was done out of spite or if this was the foot in the door to get more foreign jurisdiction over us
