I think most people are hoping for a mistrial with prejudice, that was the argument made by his lawyers yesterday.

They moved for a mistrial WITH prejudice and have a legal basis for doing so. A mistrial without prejudice could still occur from a hung jury...

Its also unlikely for a Prosecutor to try to intentionally induce a mistrial. Which is what happened here.
