A Florida man fatally shot an Orlando Burger King worker Saturday night after his friend’s drive-thru order took too long to complete, according to a report.
Kelvis Rodriguez-Tormes, 37, is accused of gunning down Desmond Joshua, 22, in the parking lot of the fast food restaurant on E. Colonial Drive about 7:30 p.m., according to the Orange County Sheriff’s Office.
“You got two seconds before I shoot you,” Rodriguez-Tormes told the victim, who had only been recently hired, before pulling the trigger, WKMG reported, citing deputies.
Rodriguez-Tormes had earlier stormed to the Burger King at the behest of a woman who made a scene over a long wait time at the drive-thru.
The unidentified woman was refunded $40 and told to leave after she got out of her car and screamed she was going to get “her man” to come to the eatery, according to an arrest record.
She drove away, but soon after returned with Rodriguez-Tormes, who targeted Joshua, demanding the employee fight him.
Rodriguez-Tormes placed Joshua in a headlock before a witness separated the two, records show.
But moments later, Rodriguez-Tormes returned from his truck with a gun and shot Joshua, police said.
The employee was taken to an area hospital and pronounced dead.
Rodriguez-Tormes was charged with murder, destruction of evidence and weapons possesion.

Florida has what they call "Sunshine Laws" on all of its police reports, etc. This could happen in New York, Wisconsin, Ohio, California, New Mexico, etc. and would be reported as "One killed in drive-through robbery". There's more weird shit happens in New York City in a day than all of Florida in a week.

The verdict was the DA and prosecutors fault, they wanted Casey Anthony charged with first degree murder, but didn't have the damn evidence to prove it. The jury went with what the state gave them.
If they would've gone with second degree or something similar, she would still be locked up.

I'm not making excuses for her, I wish she had been found guilty, but it's not the jurys' fault.

The verdict was the DA and prosecutors fault, they wanted Casey Anthony charged with first degree murder, but didn't have the damn evidence to prove it. The jury went with what the state gave them.
If they would've gone with second degree or something similar, she would still be locked up.

I don't know why incompetent prosecutors refuse to request jury instructions for lesser included offenses in murder cases like this where they literally had no proof whatsoever of premeditation. They didn't even really know how the death happened and had no coherent theory of it. I think they could have easily proven that it was nearly a certainty that something Casey Anthony did resulted in that death, but whether it was a premeditated murder or an accident that turned into a coverup, we don't know for sure.

(Come to think of it, I think they may have actually tried for manslaughter too in the jury instructions but it was nearly an afterthought and they barely advanced any arguments that would let the jury go there.)
