Law Judge jails father for blaming her for son's death - Mother killed son after being given custody

(WXYZ) — He lost a custody battle, then his son lost his life. He blames the court system. He voiced his strong opinions on social media and the next thing he knew he was locked in jail.

“He was so full of life,” said Deborah Vanderhagen of her grandson. “I am trying not to cry.”

On September 22 it will be the two-year anniversary of the day Deborah Vanderhagen’s grandson Killian lost his life. She believes her son Jonathan Vanderhagen is justified in feeling the court cost her grandson his life. He died in the custody of his mom after her son asked for sole custody.

“His lawyer said something is going to happen to this child. You need to get him away from the mother. There are too many red flags. And the judge said, oh that is in the past,” said Deborah Vanderhagen.

The police report filed after two-year-old Killian died shows he had a previous medical condition and investigators did not believe there was evidence Killian’s mother was responsible. His dad felt otherwise and repeatedly posted criticism of the judge and friend of the court on his Facebook Page.

Judge Rachel Rancilio saw the posts, many of which are publicly targeted at her. She apparently felt uncomfortable and possibly threatened.

The Macomb County Sheriff’s office responded and found he criticized what Judge Rachel Rancilio pinned on Pinterest as in his opinion inappropriate, posted videos saying he feels she and others responsible for Killian’s death, and blamed the court system for his loss.

The investigative report also says at no time did he threaten harm or violence.
Still he was charged with malicious use of telecommunications services and released on bond. Then he made more posts, such as one that reads, “Dada back to digging and you best believe I’m gonna dig up all the skeletons in this court’s closet.”

A judge ruled he violated his bond conditions. He now is in jail on half a million dollars bond.

His mom says she feels he simply was exercising his right to free speech.
“He just wants justice. He don’t want to kill anybody. He don’t want anybody physically hurt. He wants them to acknowledge what they’ve done and get justice,” said Deborah Vanderhagen.

A jury trial is scheduled for September 13.

Of course it should be legal to criticize judges and all people involved with law enforcement. Does that mean it makes sense to call a traffic officer "a fucking pig" and demand he squeal for your amusement when you show up to court to have a burnt-out headlight ticket dismissed? Probably not.

The reality is you have to be extra fucking polite to judges and officers to get rulings and treatment in your favor, especially if you aren't a skin color/race match for the authority figure in question. The correct play by Mr. Vandertard here would have been to take his rant to reddit, or anonymize himself on Medium as sympathetic fan of the case. Eron Gjoni of Gamergate fame got slammed with a gag order after the woman he called out in his blogpost cried to the judge that she felt threatened & that shit stuck to him for over 2 years in a legal battle that took crowdfunding to escape. In Eron's case, he kept his mouth shut under penalty of heavy fines and jail time until a famous 1st Amendment precedent lawyer took his case pro bono, and even then he's been reticent on her drama since.

That female judge is a baby killer by proxy & neither her nor the mom should have felt threatened by the husband's shitposts online. Still, attaching those shitposts to your name is a surefire way to tank your custody case's future prospects. Dad should've exercised his free speech in a smarter way and recruited some helpers before strike 2 and landing in jail.

Jury was "three old males and four young to middle aged women" according to the local reporter. Sounds like Mr. Vanderhagen's lawyer, while a fairly dogmatic libertarian (won't hold it against him in this case) had things covered pretty well from both the 'muh constitution' and 'muh grieving father' side of things.

One pretty funny aspect- according to Judge Rancilio, she "viewed a video that scared her. The video was not available for the trial." Sounds like some pig fucked up the evidence collection. And a wicked racist like Rancilio is not necessarily particularly credible when testifying to what she supposedly saw.

At this point I mainly want to know now just how much of the context of Mr. Vanderhagen's 'stalking' posts was disclosed.. like the fact that the 'personal stuff' he was reposting from her social media while questioning whether she took child protection seriously included jokes about being a serial killer and shanking people.

"I think that Jonathan should continue speaking the truth, I think he should continue researching our elected public officials and telling people what happened to him and warning other people about the court system," Somberg said.

Did it? Did I miss something in the coverage? I thought he was still on trial and stuck in jail on a half million dollar bond. That's not justice at all.

ETA: Oh, I guess he was found not guilty. At least his peers aren't total fucking idiots. I still hope this guy sues that city/county/whatever for every penny it's got for this bullshit.

I imagine men awarded sole custody are less likely to get child support from the mother than the reverse, but they're very rare birds and this sounds a bit like a MRA talking point rather than a major factor in driving the dynamics of family law.

If it happens to him, it'll happen to anyone. As long as judges like this are allowed to continue wielding the law as a blunt instrument of pain and humiliation then i'd say violence is exactly what is needed.

Until she's truly held accountable for her abuse of the law then there is no room for justice in the courts. A lawsuit ain't gonna fix jack shit.
