Wow, so I just realized that Rooster Teeth just announced a 60% subscription price increase. (But don’t worry they bundle in free shipping on any horrible mercy you order from them. Promise!) Yeah, that is a huge sign that actual subscription numbers are cratering, and they are papering it over by trying to get more revenue from whatever dedicated pool of whales they have remaining. This is what is known as “the Marvel Comics Way” of shady accounting. Whenever you see a price increase like that that is greater than ~20% assume things in the back office are going to shit.

This along with the recent DeathBattle (which in my opinion seems like a thinly veiled jab at Vic with his favorite character out of the ones he's voiced) makes me wonder if Rooster Teeth as a company has a death wish, or their just stupid, or why not both.

I think they should try anyway. A different panel might come to a different decision. And if they do, but Vic also has something to appeal, I think they'll take the permissive interlocutory appeal.

I was trying to make sense of how the Appeals Court reacts to TCPA appeals. It seems to vary wildly by District? With each District behaving differently. A common refrain was some Districts felt they had limited power in questioning the trial judges decision on the matter and tend to just rubber stamp the trial court ruling excepting some really egregious circumstances.

The District Court Judge Chupp presides over is in the Second District, and that's the court that has jurisdiction over appeals. It's also in Fort Worth. If I'm reading it correctly, appeals cases from these courts are only binding on the trial courts in the geographical area they serve. There are also apparently District Courts that have concurrent jurisdiction over the same counties, so an appellant can pick from one or more appeals courts depending on how they feel. Also, you can apparently appeal to a different District Court of Appeal than the one with direct jurisdiction over the country court appealed from, but that court then has to apply the law of the transferee court (unless there is none).

But I think the 2DCA would be the one in charge of this case, and it would only be bound by its own law, by the Texas Supreme Court, and by en banc decisions of the full court.
