Has anyone addressed the following possibility:

Ron Soye came to believe that Monica had been intimate with Vic in the past and this caused him to become jealous and consider breaking off the engagement.

Monica panicked and told a heap of lies about Vic forcing himself on her, so that Soye would still marry her ever expanding arse, and the two of them have been gung ho for Vic, ever since?
No, not really, and after reading all the stuff in different threads in the Weeb Wars section, I'm convinced this is a well in advance and strategically planned campaign to destroy a man who doesn't fit into the agenda of those leftist cumstains like Soye, Sabat, Rial et al.
Can't it be both?

@RodgerDodger\Anominous, quick question if you have a sec. How common it is for a lawyer to be brought a TCPA \ SLAPP \ Defamation lawsuit as a practicing attorney? Is it a once a year thing or even less frequent? With all the Twitter lawyers having such divergent opinions on how this case is "supposed" to go when they dog pile on Nick, I was curious how much of this stuff they're pulling out of their ass versus facts they might have learned litigating the actual issues in court. Thanks for any feedback as always.

That really depends. Some people do it all the time or even specialize in it and some may not ever file one. Not every lawyer is in some litigation boutique that focuses solely on one kind of lawsuit.
 
What would stop them from just fabricating a report? It seems like a lot of this to me is just easy to withhold or make up without getting caught. I could be completely wrong but why couldnt they do that with discovery since it relies on them giving the information out themselves.
The threat of proper ruination. They lie and get caught, and remember how remarkably incompetent every defendent has been so far, and their case fries immediately. They cannot deny malice at that point.

Sorry if I'm a little behind, but TCPA says discovery until its ruled on, right? If so, Vic wouldn't be able to get at any further evidence to help overcome the TCPA before its ruled on.

He's only working with whatever evidence he started the suit with until the motion is ruled on. And if the TCPA succeeds, there will be no discovery. Is this basically correct?

He can request limited discovery specific to the TCPA motion. Which Funi's motion has left open some rather broad subjects. Such as the Funi/Sony investigation, at least documents.
 
Again, these people are just wrong again. Tortious interference with a prospective business relation does require an independently tortious act. Tortious interference with an existing contract IS an independent tort.

All or nothing in regards to this case. They could always be sued for something else in the future.

Like anything else in the world, it's entirely possible that anything possible happens. And yes, that's possible. The defamation case against them, based on one Tweet, is actually quite weak. Some form of vicarious liability, as weak as those kinds of cases tend to be, too, may be stronger in this case.

Or they even may win outright.

Mindless triumphalism of the sort you see from "right side of history" Twitter dumbasses is not reality.
 
It confuses me why they would have needed to bring yet another lawyer into the case if all the others are staying on. Was Casey unable to do depos? Was Parez? Seems like a waste.

For the curious, no Nick isn't going to be keelhauled by his State Bar for allegedly being guilty of "maintenance." There is a United States Supreme Court case, NAACP v. Button, where it's held that a state cannot restrict lawyers or non-lawyers from providing support (such as legal advice, non-legal advice, and encouragement) by invoking the state’s power to exercise its police powers to limit maintenance and champerty.

What this means is that Nick is free under the First Amendment to engage in selfless maintenance (encouragement, setting up a GFM Fund, saying "Got Get Em" and commenting on the case) designed to protect constitutionally protected rights through litigation. If Nick was outright funding the case financially, I'd want to do some more research. But exercising his free speech right to encourage people to donate to Vic? Nah, that's not gonna fly. This is just pure nastiness by the defendants. And God, I hope they lose their TCPA motions when they come.

It's not nastiness - well, it is, but the underlying reason is they're shooting all the bullets anywhere they can in a blind attempt to hit something that will give them a chance to win the case. If that's the TCPA or Nic or cannibalizing one of the other defendants, it each represents a 1% chance of winning a case they would have 0% chance of winning without, so they'll keep trying.

It's much more desperation than malice at this point. That is not to say they aren't enjoying doing it though, because as 400 tweets prove, they are, indeed malicious.

I'm aware of both of these. I am sort of a fan of these odd zombie doctrines that have been more or less abolished. Literally the only way these dumb arguments against Nick possibly win is by reviving them. My personal opinion is sorry, necromancy is not a doctrine in the law and you can't just revive these things that have been abrogated both in common law and, even more often, by actual statute.
