I'm beyond incredulous that they would choose to go after Nick. I cannot think of what they stand to gain by that. Someone mentioned the idea of them trying to out spend Vic and make him run out of money first, but this decision doesn't even do that. They can't access info related to the GFM spending, they can't stop/kill the GFM, they can't cause Nick any substantial trouble, he's been predicting and I'm sure also preparing for this this happen for months, what the fuck are they after?

I think these people are convinced that Nick is going to do something illegal with regards to the deposition they want to do on him. It's so hilarious that they decided to still file intent to depose Nick AFTER a TCPA was filed, though. It's also hilarious how law twitter hasn't even mentioned ONE TIME the stupidity of asking for discovery from Nick during the stay of discovery. The "calling out" only happens in one direction, and we all know exactly why. Nick calls out Ty when he thinks he's done something wrong. Right, I think they're conflating the "for the purpose of intimidation by burdening with cost" with the "no valid, actionable defamation." The first is merely circumstance unrelated to law, the second is the legally relevant part. The ONLY way to win under TCPA is to prove the second portion.

Even if you grant the first part, it DOES NOT cover all necessary parts for it to be a SLAPP suit, especially considering that the plaintiff (and Nick, if you are willing to grant that he is an agent of Vic, which no reasonable person is) absolutely and most certainly believes he has a fighting chance to win this lawsuit, and that's obvious to anybody seriously involved. The majority of SLAPP suits are brought by plaintiffs who really don't think they have a chance to win, they just want to intimidate.
