Did you read the ruling? I don't think Raw doubles the runtime of the dsp streams with the commentary he adds (none) to the restream. The ruling also is specific to factual content (documentaries, exposé, essays) , or at least doesn't really apply to reacting to creative content. If dsp made a 1h video attacking his alogs, and raw reacted to the video with the end result being 2h long, you'd have a point.

But in any case this was probably just a content ID or youtube copyright policy based termination or at worse a DMCA takedown. Those have different rules anyways. So ethan could've gone through twitch and dmca'ed the reaction stream easily, but he preferred suing. Only retards chose to risk a lawsuit instead of using DMCA or content id. DMCA and platform specific content policies are usually much more favorable to IP owners than courts are with fair use.

To be clear, regardless of copyright law, idc if someone stole or restreamed from any "content creator". He plays video games in front of a camera, who gives a shit about IP.

I really want to see DSP try and take Raw off of Rumble they legit let people do any fucking thing on there including crimes and straight up restreaming movies. If Raws Twitch goes down I would assume that means superfaggot is involved again because DSP isn't gonna file the DMCA and shit.

I don't know man, as someone very late to the party I'm entertained. Phil gets a little victory but can't handle it the correct way, his alogs are mad and will probably enact some goofy plan soon. Meanwhile Phil doesn't seem to be able to function without some kind of background conflict going on in his life so eventually he'll create it himself. It's all up in the air right now, good shit.

In the meantime I'm listening to The Dent Sea Scrolls with that Jaha guy and it's funny as hell. I'll take an entire Kino Casino of laughing at Phil than having to listen to another word about Jeremy Hambly.

The thing about restreamers like RawPhil is that there is a ethical argument to be made about why they exist.
Phil is a very disingenuous person, to say the least, because he's a lying piece of shit and there's like 20 years to support this claim. Even if you take Phil at his word, he's admitted to lying and being dishonest for his own benefit. Yes, RawPhil is downright a copyright infringment because at the end of the day Phil's slop is still intellectual property on technical terms. However, there is an argument to be made about why a raw restream is necessary as Phil just lies. We've seen it on many occasions, notably his "YouTube mode" where he will berate his audience and then quickly change once the "recording" begins.

Can you imagine how much Phil would lie if there wasn't people clipping him? Even then, he downright denies saying things despite there being video evidence of the contrary. RawPhil offers more than just a safe chatroom, it's a repository where you can see what Phil often tries to deny. How could you prove that Phil lied if there wasn't a clip that states otherwise? If the restream was transformative, Phil and I imagine a lawyer could claim his words were manipulated and therefore aren't representative of reality, and since the raw archive can be deleted by Phil at his convenience, that creates the need to have a raw archive.

Copyright law and the law in general is more philosophical than people think. It's not a science set in stone, it's a long game of semantics, that's why that case could go either way. Indeed, "what is a restream?" "when does it become transformative enough?" That's why it's about how it's presented, and thanks to people like RawPhil or any other clippers like Memology there's evidence that Phil has downright claimed restreamers don't bother him and they don't represent a loss, statements that would be lost if Phil was the only source of said claims because if you were to present to Phil's lawyer (hypothetically) what is your evidence and the source, he could just scrub it off.

If anything, this could have been a good time for Phil to prove his theory about how if detractors disappeared, he'd be Mr. Beast levels of famous, but again, just imagine the shit he'd be saying and claiming if he could completely control the narrative.
