I'd take this a bit more seriously folks. OFCOM is a bunch of retarded UK cocksuckers but they are a government entity and do have a lot of power to exert should they choose too.

They are testing the waters with this 4Chan fine, because they don't think anyone will step forward to defend such a faggot site. It's the censorship playbook 101. Attack the things people won't dare defend to set the tone before attacking the main target. After they've made 4Chan bend the knee they will move on to bigger targets.

They can sue and in the US court system they could very well win given the right judge and the right state, and that would set a terrible precedent as once the UK proves it can enforce it's will on US companies, then so will many other cucked nation like New Zealand and Australia. Who would like nothing more then to make the Great Chink Firewall a thing in their own countries.

This is a serious matter and we are lucky some decent lawyers took up the cause pro-bono. Laugh if you want but OFCOM is not joking, they want power over what you do on the internet and they do not give a single shit about anything else. To a Brit-cuck bureaucrat the First Amendment is just so silly trash written by Yanks because they're just stupid hicks.

Remember, they hate you and everything you stand for and will do whatever they can to make you suffer just because you don't believe in what they want you too.
A few things...

Ofcom is a private corporation assigned to enforce various things. They are not a government entity.

And if they wanted they could do a great fire wall right now and be done with it. But they are too afraid of doing that because they would get extreme backlash if they did.
 
Problem is, that OFCOM does not actually honor their promise to not pursue websites that geoblock UK. The suicide forum in your screencap that is shown as a success story is a lie. OFCOM is still pursuing them.

Suicide forums kind of deserve it. Null opened this site because he enjoyed Chris Chan gossip. People run Imgur because they like funny pictures. If the people who run suicide forums liked suicide they’d be dead already. They have a perverse interest in encouraging and facilitating others to kill themselves. They should be on a cross.

It's something that gets overlooked. In pretty much every other country in the world, discovery is very limited. In the US, you can get tons of shit and that would necessarily include internal OFCOM documents: internal conversations, how they calculate fines, how they decide who to fine and who to ignore, why they go after certain entities, and so on. The UK government likely doesn't want its dirty laundry aired.

Objectively no. They have broken no law. They have the right to speak about suicide. And frankly we on the farms talk about equally disturbing things. Once they go, the rest of us are in OFCOM's sights.

Which it would not be if it was MI-5 or an actual ministerial department being their internet censor. But its not. OFCOM is one of Blairs deputized corporations. It works on BEHALF of the government with statutory power. But its not the government. Except when it wants to be. Its rather perverse and I hope the district court in DC agrees.

You cant be both a private corporation and the government at the same time. Especially when you are reaching across international borders. Either one is good for this particular case though. If OFCOM is the UK government they can be told to fuck off. If they are a private corporation then they can also be told to fuck off. The legal games OFCOM plays works in the UK, but it does not work in the USA.

I'm not sure about the UK if you mean them. Generally the federal government can't do that at all unless authorized by statute. If you're talking about the UK or even Ofcom, I wouldn't even guess.

I see what you meant now. And no, the general principle that if the government is the one filing a suit, they waive sovereign immunity just for the purposes of that suit.
