The issue isn't even that, not really, it's that the gun ND'd. A gunshot is basically Go Time for any sort of action, and the assumption of 'if I don't kill this guy now, me or one of my buddies is going to die'.

If the gun did indeed fire then it depends on if he accidentally pulled the trigger, or if it was a P320 malfunction.
Then the gun would need to go to an independent testing facility, with a full chain of custody, where it would need to be tested thoroughly with multiple people present, to figure out if that gun could indeed discharge without pulling the trigger.
Right now we do not even know if an agent fired the first shot, thinking the victim had drawn his weapon, or if it was a P320 NG.
