We actually don't know if Monty had pro bono representation. A popular theory here was that Schneider was working at a deeply discounted rate, but that's just the usual thread speculation. Nick himself said that he thought Schneider was working on contingency, but Nick's opinion means even less than anyone here.

What we know is that, when it came to the appeal, Monty had to raise money to bring in a guy that specializes in appeals (meaning that very definately wasn't pro bono). He out-raised Nick... and then... beat Randazza with a much cheaper lawyer. Cue Cokestream.

It would actually be pretty funny if Monty's total outlay for this whole thing is pretty insignificant and, in return, he caused Nick to burn hundreds of thousands of dollars, and get so fucked up on coke on a livestream that the 5-0 noticed and included it in a search warrant application. It would still be a Nick W against Monty, I suppose, but a really pyrrhic one.

It also makes one wonder what would ever happen if Nick pissed off somebody with less baggage but more money.

Monty was upfront that it was gonna take a hell of a lot of money to go the full distance. Specifically, after switching to Hardin, he asked for $85,000, in addition to the $15,000 he asked for (and got... or at least close enough) to successfully defend against Nick's appeal.

Unfortunately, since Monty won at the appeals court last year, he has only gotten an additional $2,000 to $3,000. Which I imagine isn't gonna buy much. Hardin would have to be be both super fucking charitable when it comes to his fees, and there are still expenses.

Hardin may have simply given him an assessment that meeting the actual malice standard is nightmarishly difficult and even if he won, he could look at still being out huge amounts of money without fee shifting. Look at Vic's case where a pretty clear prima facie case ended up thrown out and massively punitively sanctioned because Ty Beard is a bumbling idiot who made a huge procedural error.

Monty always struck me as the type of a guy who wasn't in this for the money, but rather out of principle. I think he asked for the bare minimum in damages just to get the foot in the door. He seemed like he simply wanted an adjudication that he does't "suck little boy cock." He wanted his day in court. He wasn't claiming he was worth a bazillion dollars.

Unfortunately, it appears he ran into an age old problem: Litigation in the United States is expensive as fuck. That's not his fault. That's just the way it is. He still made it farther than a think of lot of people expected him to.

Well, fortunately, there is no fee shifting here, and Monty built up a solid judicial record that suggests he may have won this if he had more resources (look for Balldoguards to claim it was "thrown out" though).

At the end of day, the biggest winner in all this is probably Marc Randazza. I dunno if the figure he gave on Twitter is accurate (it suspect it's bullshit), but he probably is still getting a hell of a lot of money out of Nick. Nick spent way more on this than was economically rational. Way more of he had just apologized to Monty and issued a retraction.

Hope Nick's ego was worth it. Nick probably could have put one or more kids through university for what he's spent on this (that is, assuming Nick even cared about higher education for his children... which he has said he doesn't).

Unequivocal Marc Randazza win. Marc had an honestly horrible case with bad facts and dipshit client who constantly made the case more difficult and undoubtedly is hated by the local bench, but still managed to drags things out by creating avenues of attack and delay until Monty exhausted all his resources and had to dismiss. Truly a master class in defense-lawyer bullshittery.

Monty didn't even make it to discovery.

I'm sure that's the lawyer position, and I get where you're coming from, but some of us non-lawyers still want to believe in silly things like truth and justice, and not view everything in terms of how much money somebody can get. Sue me (pun intended). 🤷‍♂️

No, but he avoided dismissal twice (once with Fischer, and again with the appeal's court), and I really suspect if he were able to hang on a little longer, Wentzell would have told Randazza to pound sand on a third attempt. If he had the resources, he might have gotten all the way to a jury.

That's gonna help Monty when it comes to Balldoguards rewriting history and claiming this whole thing was frivolous (which they will, mark my words). Monty just plum ran out of money.

Unlike Vic's case, Monty's side did not commit a catastrophic legal error. Unlike Vic's case, Randazza did not get his anti-SLAPP. I see this as distinguishable from how Vic ended, though perhaps every bit as disappointing.
