Like all "what if the Democrats use this tactic against us?" fears, the Democrats have already been using that tactic for years. Tons of gun cases have been thrown out because the plaintiffs didn't risk spending the rest of their lives in jail by breaking the unconstitutional law before suing.

as much as a pain in the ass as it would be, i think the best set up is having the lists curated per state. red states can ban stuff for children they don't like, and blue states can ban stuff for children they don't like. it's not a perfect system, but that's pretty much how these kind of things work now. it may be naive, but i would hope that having a chokepoint for minors' access to the internet would at least make it much, much harder for groomers to have Discord chats or Roblox levels that draw in children who then get spammed by porn or grooming messages

it's not a magic bullet that will fix all problems. but the purpose is to have some kind of enforceable, concrete divide between minor spaces and adult spaces on the internet. the system i'm thinking of isn't just to stop minors from accessing porn, which seems to be a blind spot for some people. what really needs to happen is breaking down the idea that we have apps like Discord where adults and children use the same app and can easily intermingle in the same places

the next question is, "how do you prevent the adults that are required to janny these spaces from grooming the children themselves?" well, unfortunately, that's a problem you face with any kind of place where children are present. ultimately having a stringent hiring process, filtering out the generic groomers who will spam porn at kids out in the open, and making it so a pedophile needs to be really, really sneaky to groom a child is the best that you can do

Is an art hoe taking nude OF pictures of herself with "FREE GAZA" pornographic or is it an artistic political expression? Do we have to show ID to use twitter now because people post lewd photos and drawings on it? What level of lewd ultimately makes something obscene?

My gut feeling is that a lot of this is going to get neutered as courts have to tackle this on a case-by-case basis and the case law will probably get quite messy.

At the risk of looking like a moron, I wonder if this whole anonymity thing is something that cryptocurrency could actually solve.

You use your ID to generate an anonymized token that you then use to access an 18+ space. The only question would be how to keep kids from getting wallets and collecting tokens from adults, but at that points you're already operating beyond the average "I'm not gonna install an app that's not on the app store; I could get a virus" zoomer tech-proficiency level.

That's kind of the point I was going for, which is that ultimately it's all about having the right people in power no matter what the laws are.

That and the idea that PR can be more important than what's actually enforced. I think most of the problems we have could probably be solved if Hollywood were cleared out and made to put out better material for 10 years.
