He's not currently being accused of a crime and the law Pxie is pursuing legal action under is not a criminal law. It's purely a civil matter as far as we can tell.

As far as whether this might be thrown out, @GarlicFragment found a reddit comment that covers another case that pertains to this law, and in that case the judge was willing to grant a TRO to the plaintiff pursuant to this law even though the alleged disclosure occurred before this law took effect. Keep in mind though that the judge granted a restraining order, not monetary damages, it isn't obvious what another judge may do. There's also the more open legal question of whether Destiny's original 'disclosure' was a single discreet event or if the disclosure could be considered to have happened continuously over a period of time, stretching into the effective date of this law.
