Late but couldn’t resist replying because this is fake as hell. King Spa is a franchise of Korean sauna/spa (complete with some really lovely baths if you ever get the chance to go) and when you enter the front doors you basically have just the front desk and two doors, one for the mens and womens baths/changing rooms. They do scan IDs at the entrance and I’ve no doubt he was given a blue tag/keys - they give either blue for boy or pink for girl. Once you get into the locker rooms you’re given a “uniform” (usually blue/grey for boy and pink for girl) that you must wear once you exit the bath area and enter the common sauna area.

However, everything after that part is an obvious cope. The ajummas/old ladies working in the locker rooms monitoring them will chew you out for talking too loud in the bath, there’s not a chance in hell they see a man walk into the womens locker room in the mens uniform and say nothing, to say nothing of the reaction of women in there (often other Koreans or older women IME - who will not stand for that shit). The only way this happened is if somehow everyone in the sauna didn’t notice an obvious man in a completely different color of uniform enter the wrong locker room and ask for a different uniform once in it, or if they ignored it to prevent another Wi Spa situation.

I know a lot of troons are the type to crow about BLM but the lack of respect they have for other cultures is astounding. Single sex saunas/bathhouses are really big in Korean (and afaik East Asian in general) culture, it’s not just a big tub. Having the baths/lockers be single sex is part of why both sexes can relax and enjoy. There’s an entire huge sauna area where they could’ve hung out that isn’t gendered in the slightest and it’s the largest part of the entire building (it even includes a restaurant, movie theatre, and sleeping area besides the sauna facilities themselves). His insistence on entering the women’s facilities isn’t about being able to spend time with his girlfriend, which men can absolutely do at any Korean sauna outside of the single sex bath area, but about invading a female only space and his own self-gratification.

In my ftm days when I would go I would often be given a blue key and have to ask for the proper one at the front desk even after getting my ID scanned - I don’t believe the system “spits” out a tag, the person working the front desk has always had to manually grab a tag, scan it, and then hand it over. The fact that he was given a blue tag isn’t a function of a transphobic system (oh noes!) but likely that he just doesn’t pass. Amusing given his immense cope about being 1 year on HRT and being so feminine uwu that he would totally get harassed in the mens lockers and had to cover his moobs lest the men realize they had a dainty woman in their midst.

It’s also vaguely unsurprising that both this and the Wi Spa incident included white men demanding entrance to a female only space and disrespected Korean culture/Korean sauna’s rules. As SJW-y as it sounds, so many of these white troons come off as particularly deeply entitled white men.

So how the appeal court can side with the troon and reverse the district court's judgement without official changes being made to ADA? I dont know much about US legal / regulatory system thats why Im asking as it dossnt make sense.

Can't really answer that without reading the decision, but it does sound like an error in judgement. It's possible they're using case law other than just the ADA, but without researching it myself I can't say.

Currently, because of the way circuit appeals courts work this decision is only binding in the states that make up the 4th circuit. Other circuits can agree with them if a similar case comes up in their district, but they don't have to.

For a relevant example: lolcow Russell Greer is suing the Farms because ~reasons~. He lost (rightfully) and is appealing in the 10th circuit. His whole case for copyright infringement rests on a few cases from the 9th circuit. He lost for multiple reasons, but one of them was 9th circuit decisions don't automatically apply in any other circuit. Our lawyer replied to his bullshit Friday and made a good illustration of what happens when cross-circuit cases are sited: doesn’t apply, BTFO case plzkthz your honor. If you're really curious about the details the post with his response is linked in the community happenings thread. (I may have the circuits backwards) The brief is very readable and lays out a good case for us to win, which is very important.

The government is almost guaranteed to appeal to the Supreme Court. Given the controversy of trannies at large SCOTUS will more likely than not take up the case. Given that the Court is made up of mostly conservatives, odds are they will agree that the ADA says no, BTFO trannies. Especially since the ADA explicitly says no.

At that point it becomes the law of the land that trannies do not have a claim under the ADA. The only way to change that is by getting another Court in a generation or two to change their minds. Possibly they could change the ADA, but good luck with that! Congress can barely agree on the time of day.

TL;DR: this case is likely judged in error, it's only applicable in a handful of states, there will be an appeal, SCOTUS will probably say BTFO trannies.

It’s the inverse of mtfs adding what they think are feminine typing patterns (tildes, :3 faces, lots! of! exclamation points!, and increasingly keymashing and lowercase typing a la tumblr girls from 2012) but ftms try way too hard and apparently can only express their manly energy through copious dudes and bros in their posts. No men’s forum would have people responding like reassuring girlfriends or an overcompensating dudebro unless it was heavy sarcasm. It’s so ridiculous it borders on parody.

Also wrt the “only 17% of cissies want to fuck tranners” seething they seem to forget the rest of the study’s results: about half of trannies and “queer” identified people don’t wanna fuck them either, and almost a quarter were “incongruent” meaning they may have put they’re attracted to women but indicated they’d date ftms but not mtfs (which is more congruent than anything, but I digress). The wrongthink is coming from inside the house.

It’s been posted about ITT before but it bears repeating. Basically every group has some small percentage willing to date ftms (even straight men, big thunk moment) but less so mtfs, resulting in about 3.3% discrepancy between the two. Only 1.7% of all respondents were willing to date mtfs versus 5% willing to date ftms, and including both only raised the percentage to 5.8%. This is partly because of the aforementioned “incongruence” - lesbians and straight men willing to date ftms despite ftms supposedly being men, while not being willing to date mtfs. Lesbians had the highest rates of “incongruence”, incidentally, which makes sense because no lesbian is going to date a mtf while loads of ftms are basically butch women with a mental disorder.

The study really just shows you can label people incongruent and exclusionary all you want but a person attracted to women overwhelmingly wants an actual woman, and the same follows for men. Even trannies and kweerios steeped in this bullshit can’t pretend they really are cool with girldick if they’re female attracted. Ftms only benefit imo because so many aren’t getting genital surgeries - a small amount of lesbians would probably be okay with a masculine woman with no boobs and a deeper voice, but literally none would want to fuck a man with a crossdressing fetish and either a “princess wand” or an amhole. That’s just how it is lol. Ditto for gay men who won’t settle for flesh sausage.

The more trannies ree about this the worse it looks for them. Their best weapon is social pressure, going mask off and saying only a tiny fraction of people are willing to date them just highlights how isolated and removed from reality this all is. Most people aren’t going to date troons, and the more people find out that’s actually a normal, extremely common thing (in about 95% of heteros and about 60% of LGs - even less for the latter if you factor in “incongruence” to the “exclusionary” percentage)the better for normies imo.
