You are absolutely correct, folks tend to ignore that fact and the 10th amendment has been getting fucked over for a good while. If we are honest, the civil war probably broke it ot the point of no repair, but we will see. This is a step in the right direction, gay marriage getting kicked back to the states is on the menu now as well probably.

Probably an unpopular opinion, but it's not impossible that someone leaked it to get a wayward "yes" vote (to overturn) back on board.
