The prosecution does have to establish the basic foundations of the case, that the dead people are indeed dead and not just pretending, that they died of being shot and not sudden drug overdoses or heart attacks, that Kyle was the guy who shot them, etc. I doubt there will be any problems with this aspect of the case because it's so basic, it's just going to take a while because this is the court system and everything takes forever.

Looks to me Kyle is going to be acquitted of murder but the firearm charge is going to stick.
It's up to the jury.
Which, to be fair, would be a perfectly reasonable way to go. Unfortunately we live in clown world, and I’m sure there are powerful people that want an example to be made. Forgive me if I have little faith in anything in this country after all the shit from the last 2 years.

doubt many. people have thought about it. there was that fat lady who took pics with keith ellison that caught some of the jury that was never punished.

Viva Frei's streaming partner Robert Barnes thinks the Jury comes in predetermined in their minds. Some of them will still argue that he is guilty because he put himself in harms way in the middle of it. I find this approach incredibly unconstitutional. Because it implies that we cannot take steps to defend our communities should those charged with doing so abdicate.
So if the poll the jury on a deadlock and it comes to a few guilty votes out of 12 does the state retry the case?

Their has to be a cut off where if the number thinks Kyle is guilty is below a certain threshold then continuing charges becomes a waste of money.
